                             BY REVENUE AND TAXATION COMMITTEE
                                                                        
  1                                   A JOINT MEMORIAL
  2    TO THE SENATE AND HOUSE OF REPRESENTATIVES OF THE UNITED  STATES  IN  CONGRESS
  3        ASSEMBLED,  AND  TO THE CONGRESSIONAL DELEGATION REPRESENTING THE STATE OF
  4        IDAHO IN THE CONGRESS OF THE UNITED STATES.
                                                                        
  5        We, your Memorialists, the House of Representatives and the Senate of  the
  6    State  of  Idaho  assembled  in  the Second Regular Session of the Fifty-sixth
  7    Idaho Legislature, do hereby respectfully represent that:
                                                                        
  8        WHEREAS, under tax relief legislation passed in 2001, the  death  tax  was
  9    temporarily phased out, not permanently eliminated; and
 10        WHEREAS,  women  and minorities are very often owners of small and medium-
 11    sized businesses, and the death tax prevents their children from  reaping  the
 12    rewards of a lifetime spent trying to make a better life; and
 13        WHEREAS,  farmers  will  face losing their farms if the federal government
 14    resumes the heavy taxation of the estates of people who invested most of their
 15    earnings back into their farms; and
 16        WHEREAS, if the estate tax had been repealed in 1996, over the  next  nine
 17    years the United States economy would have averaged as much as $11 billion per
 18    year in extra output, and an average of 145,000 additional new jobs would have
 19    been created; and
 20        WHEREAS,  the  persistent uncertainty created by the sunset provision pre-
 21    vents families and small businesses from taking advantage of the repeal; and
 22        WHEREAS, having passed both the United States House of Representatives and
 23    the United States Senate, the elimination of the death tax has proven to  hold
 24    wide bipartisan support.
 25        NOW,  THEREFORE,  BE IT RESOLVED by the members of the Second Regular Ses-
 26    sion of the Fifty-sixth Idaho Legislature, the House  of  Representatives  and
 27    the Senate concurring therein, that we urge the members of the Congress of the
 28    United  States  representing  the  state of Idaho to support, work to pass and
 29    vote for the permanent repeal of the death tax.
 30        BE IT FURTHER RESOLVED that the Chief Clerk of the  House  of  Representa-
 31    tives  be, and she is hereby authorized and directed to forward a copy of this
 32    Memorial to the President of the Senate and the Speaker of the House of Repre-
 33    sentatives of Congress, and  the  congressional  delegation  representing  the
 34    State of Idaho in the Congress of the United States.
