|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-sixth Legislature Second Regular Session - 2002IN THE HOUSE OF REPRESENTATIVES HOUSE JOINT MEMORIAL NO. 19 BY STATE AFFAIRS COMMITTEE 1 A JOINT MEMORIAL 2 TO THE SENATE AND HOUSE OF REPRESENTATIVES OF THE UNITED STATES IN CONGRESS 3 ASSEMBLED, AND TO THE CONGRESSIONAL DELEGATION REPRESENTING THE STATE OF 4 IDAHO IN THE CONGRESS OF THE UNITED STATES. 5 We, your Memorialists, the House of Representatives and the Senate of the 6 State of Idaho assembled in the Second Regular Session of the Fifty-sixth 7 Idaho Legislature, do hereby respectfully represent that: 8 WHEREAS, the Constitution of the United States sets forth the method and 9 basis for selection of members of the Senate and House of Representatives of 10 the Congress of the United States; and 11 WHEREAS, in the Constitution, each state is allotted two Senators and the 12 number of Representatives based upon the population; and 13 WHEREAS, the provision of two Senators for each state recognizes that the 14 basis for representation in the two legislative bodies should not be the same, 15 and that the two bodies can effectively represent the states and the citizens; 16 and 17 WHEREAS, through interpretation of the Constitution, the Supreme Court has 18 concluded that the state legislatures cannot choose to follow a similar pat- 19 tern of federalism in their own legislative bodies; and 20 WHEREAS, it is appropriate that the states should follow a pattern which 21 would ensure representation to the counties and similar jurisdictions of our 22 sister states; and 23 WHEREAS, an amendment to the Constitution of the United States is there- 24 fore essential to accomplish this purpose and reestablish a time honored sys- 25 tem of legislative representation in the states. 26 NOW, THEREFORE, BE IT RESOLVED by the members of the Second Regular Ses- 27 sion of the Fifty-sixth Idaho Legislature, the House of Representatives and 28 the Senate concurring therein, that we urge the Congress of the United States 29 to adopt and submit to the several states an amendment to the Constitution of 30 the United States which recognizes the principle which applies in the Congress 31 and allows the states to adopt a similar pattern of apportionment within the 32 respective states. 33 BE IT FURTHER RESOLVED that the Chief Clerk of the House of Representa- 34 tives be, and she is hereby authorized and directed to forward a copy of this 35 Memorial to the President of the Senate and the Speaker of the House of Repre- 36 sentatives of Congress, and the congressional delegation representing the 37 State of Idaho in the Congress of the United States.
STATEMENT OF PURPOSE RS 12050 The purpose of this Joint Memorial is to request an amendment to the United States Constitution that will render void the United States Supreme Court Ruling that forced reapportionment on all of the states, causing great expense and inconvenience to all of the states, including the State of Idaho; and will allow self determination of the government of each of the 50 states, provided that form of government is a republic.
