|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-sixth Legislature Second Regular Session - 2002IN THE SENATE SENATE BILL NO. 1296 BY STATE AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO THE PREQUALIFICATION OF CONTRACTORS AND SUBCONTRACTORS; AMENDING 3 CHAPTER 57, TITLE 67, IDAHO CODE, BY THE ADDITION OF A NEW SECTION 4 67-5711E, IDAHO CODE, TO PROVIDE FOR THE PREQUALIFICATION OF CONTRACTORS 5 AND SUBCONTRACTORS ON CAPITOL BUILDING CONSTRUCTION AND RENOVATION PROJ- 6 ECTS, AND TO PROVIDE CONDITIONS IF PREQUALIFICATION IS USED; DECLARING AN 7 EMERGENCY; AND PROVIDING A SUNSET DATE. 8 Be It Enacted by the Legislature of the State of Idaho: 9 SECTION 1. That Chapter 57, Title 67, Idaho Code, be, and the same is 10 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 11 ignated as Section 67-5711E, Idaho Code, and to read as follows: 12 67-5711E. CAPITOL BUILDING CONSTRUCTION AND RENOVATION PROJECTS -- 13 PREQUALIFICATION. With respect to any contract to be entered by the director 14 of the department of administration or his designee for capitol building con- 15 struction and renovation projects, and any part thereof, the administrator of 16 the division of public works may require contractors and subcontractors to be 17 prequalified. If prequalification is used, the following conditions shall 18 apply: 19 (1) Adequate public notice of the prequalification process, including the 20 written criteria and procedures for prequalification, shall be given at least 21 fourteen (14) days prior to the date prequalification applications are due 22 including publication in a newspaper of general circulation in the area where 23 the work is located, and shall include instructions on the prequalification 24 application process; 25 (2) Only contractors and subcontractors licensed in Idaho to perform pub- 26 lic works contracts shall be eligible for prequalification; 27 (3) At least five (5) or more general contractors and subcontractors 28 shall be prequalified for the construction or renovation project or applicable 29 part thereof. However, if less than five (5) contractors or subcontractors 30 request to be prequalified or if less than five (5) contractors or subcontrac- 31 tors meet prequalification requirements, then only that number shall be pre- 32 qualified; 33 (4) Prequalification determinations shall be based on written criteria 34 and procedures established by the administrator of the division of public 35 works and approved by the permanent building fund advisory council; 36 (5) Following the prequalification determination, competitive sealed bid- 37 ding shall be accomplished in accordance with the provisions of section 38 67-5711C, Idaho Code; and 39 (6) When the prequalification process is used, only prequalified contrac- 40 tors shall be permitted to bid. If the contractor is submitting as a general 41 contractor, its subcontractors named must also be prequalified. 42 SECTION 2. An emergency existing therefor, which emergency is hereby 2 1 declared to exist, this act shall be in full force and effect on and after its 2 passage and approval. 3 SECTION 3. The provisions of Section 1 of this act shall be null, void 4 and of no force and effect on and after June 30, 2008.
STATEMENT OF PURPOSE RS 11426C2 Idaho's capitol building is a significant public monument, symbolizing Idaho's sovereignty and the spirit of Idaho's citizens. The capitol building is one of Idaho's most renowned landmarks. The Idaho Legislature has recognized the importance of the capitol building by the creation of the Idaho state capitol commission and the funding of the capitol renovation project. This legislation will allow the Department of Administration, Division of Public Works to require contractors and subcontractors to be pre-qualified in their area of work in order to bid or be included in bids for work on the capitol building, where a contract is to be entered by the director of the Department of Administration or his designee. The purpose is to ensure that the renovation work is done by craftsman and contractors with the skills necessary to successfully complete the required work in a timely fashion.
