  1                                        AN ACT
  2    RELATING TO IDAHO WILDLIFE SPECIAL LICENSE PLATES;  AMENDING  SECTION  49-417,
  3        IDAHO CODE, TO PROVIDE FOR THREE IDAHO WILDLIFE SPECIAL LICENSE PLATES AND
  4        TO  PROVIDE  FOR DESIGN OF THE PLATES; AND AMENDING SECTION 49-402C, IDAHO
  5        CODE, TO PROVIDE APPLICATION TO PLATE DESIGNS FOR THE IDAHO WILDLIFE  SPE-
  6        CIAL LICENSE PLATES.
                                                                        
  7    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  8        SECTION  1.  That  Section  49-417, Idaho Code, be, and the same is hereby
  9    amended to read as follows:
                                                                        
 10        49-417.  IDAHO WILDLIFE SPECIAL PLATES. (1) Any person who is the owner of
 11    a vehicle registered under the provisions  of  section  49-402  or  49-434(1),
 12    Idaho Code, may apply for any one (1) of two three (23) Idaho wildlife special
 13    license  plates. The provisions of this section shall not apply to any vehicle
 14    with a registered maximum  gross  weight  over  twenty-six  thousand  (26,000)
 15    pounds.
 16        (2)  In  addition  to  the  regular  operating fee, the applicant shall be
 17    charged a fee of thirty-five dollars ($35.00) for the initial issuance of  the
 18    plates, and twenty-five dollars ($25.00) upon each succeeding annual registra-
 19    tion.  Ten dollars ($10.00) of the initial fee and ten dollars ($10.00) of the
 20    renewal fee shall be deposited in the state highway account and shall be  used
 21    to  fund  the  cost  of  administration of this special license plate program.
 22    Twenty-five dollars ($25.00) of each initial fee and fifteen dollars  ($15.00)
 23    of  each renewal fee shall be deposited by the state treasurer in the fish and
 24    game set-aside account pursuant to section 36-111, Idaho Code, for use in  the
 25    nongame  wildlife  program. This fee shall be treated as a contribution to the
 26    nongame wildlife program, and shall not be considered a motor  vehicle  regis-
 27    tration  fee  as  described in section 17, article VII, of the constitution of
 28    the state of Idaho.
 29        Whenever title or interest in a vehicle registered under the provisions of
 30    this section is transferred or assigned, the owner may  transfer  the  special
 31    plates  to  another vehicle upon payment of the required transfer fees. He may
 32    only display the plates after receipt of new registration from the department.
 33        (3)  Notwithstanding the provisions of section 49-402C, Idaho Code,  eEach
 34    Idaho  wildlife license plate shall be of a color and design acceptable to the
 35    board of directors of the Idaho fish and wildlife foundation and  approved  by
 36    the  department, utilizing a numbering system as determined by the department.
 37    The Idaho fish and wildlife foundation is authorized to design more  than  one
 38    (1)  wildlife plate, but the department may not allow more than two three (23)
 39    different designs to be in use at any one (1) time. Initial costs of the plate
 40    program including costs of plate design shall be paid by the  Idaho  fish  and
 41    wildlife foundation.
 42        (4)  Sample  Idaho  wildlife  plates  may be purchased for a fee of thirty
 43    dollars ($30.00), ten dollars ($10.00) of which  shall  be  deposited  in  the

  1    state  highway  account  to be used to fund the cost of administration of this
  2    special license plate program. Twenty dollars ($20.00)  of  the  purchase  fee
  3    shall  be deposited in the fish and game set-aside account pursuant to section
  4    36-111, Idaho Code, for use in the nongame wildlife program.
                                                                        
  5        SECTION 2.  That Section 49-402C, Idaho Code, be, and the same  is  hereby
  6    amended to read as follows:
                                                                        
  7        49-402C.  SPECIAL  LICENSE  PLATE PROGRAMS -- STANDARDIZED PLATE COLOR AND
  8    DESIGN. (1) It is the intent of the legislature that  special  license  plates
  9    issued  by  the department be readily recognizable as plates from the state of
 10    Idaho without losing the uniqueness for which the special plate  was  designed
 11    and  purchased.  In  addition,  the  legislature finds that the department can
 12    operate in a more  efficient,  cost-effective  manner  by  conforming  special
 13    plates to a basic color and design.
 14        (2)  No  special  license  plates and no special license plate programs in
 15    existence on or before June 30, 1998, shall be affected by the  provisions  of
 16    this section. On and after July 1, 1998, any new special license plate program
 17    authorized or any redesign of an existing special license plate, shall use the
 18    same  red,  white  and blue background as the standard issue of license plates
 19    described in section 49-443, Idaho Code, except that:
 20        (a)  The identification of county shall be omitted;
 21        (b)  The word "Idaho" shall appear on every plate;
 22        (c)  The inscription "Scenic Idaho" may  be  omitted  without  legislative
 23        consideration and approval; and
 24        (d)  No  slogan shall be used that infringes upon, dilutes or compromises,
 25        or could  be  perceived  to  infringe  upon,  dilute  or  compromise,  the
 26        trademarks  of  the  state of Idaho, including, but not limited to, "Idaho
 27        Potatoes   ," "Grown in Idaho   ," "Famous Idaho Potatoes   "  or  "Famous
 28        Potatoes   ."
 29    The  provisions  of  this  section shall not apply to the second plate designs
 30    issued pursuant to the provisions of section 49-417, Idaho Code.
 31        (3)  Any redesign required for a special plate to conform with legislative
 32    intent and the provisions of this section may be done in a manner  similar  to
 33    that used to produce the original design.
 34        (4)  The  special plates shall conform in all other respects with the pro-
 35    visions of section 49-443, Idaho Code, relating  to  visibility  requirements,
 36    display of registration number, time period for validity of plates, and reser-
 37    vation of plate numbers.
 38        (5)  No  special  license  plates shall be issued to motor vehicles with a
 39    registered maximum gross weight in  excess  of  twenty-six  thousand  (26,000)
 40    pounds,  or  any motor vehicle registered under section 49-434(5), Idaho Code,
 41    or section 49-435, Idaho Code.
 42        (6)  Following an introductory period of two (2) years  during  which  the
 43    provisions  of  this  subsection  shall not apply, if, for two (2) consecutive
 44    years, fewer than one thousand (1,000) plates are issued per year for  a  spe-
 45    cial license plate program, the department shall so advise the legislature and
 46    assist the legislature in adopting appropriate action to discontinue that spe-
 47    cial license plate program. The provisions of this subsection shall apply only
 48    to special license plate programs created on and after July 1, 1998.

  2        On page 1 of the printed bill, in line  22,  delete  "Twenty-five  dollars
  3    ($25.00)"  and  insert:  "Twenty-five dollars ($250.00)"; and also in line 22,
  4    delete  "fifteen  dollars  ($15.00)"  and  insert:  "fifteen  twelve   dollars
  5    ($152.00)";  in  line 25, following "program." insert: "One dollar and twenty-
  6    five cents ($1.25) of each initial fee and seventy-five cents  (75)  of  each
  7    renewal  fee  shall be deposited by the state treasurer into the department of
  8    parks and recreation waterways improvement fund to  be  used  for  operational
  9    costs  for  the  boating programs and grants for boating safety or facilities.

 11    cents (75) of each renewal fee shall be deposited by the state treasurer into
 12    the  department of parks and recreation nonmotorized trail fund to be used for
 13    nonmotorized trail projects throughout Idaho.  Two  dollars  and  fifty  cents
 14    ($2.50)  of  each  initial  fee and one dollar and fifty cents ($1.50) of each
 15    renewal fee shall be deposited by the state treasurer into the  department  of
 16    agriculture  livestock  disease  control fund to be used for testing, surveil-
 17    lance, and detection of diseases that may affect wildlife including,  but  not
 18    limited  to,  chronic wasting disease."; and in line 26, delete "nongame wild-
 19    life program" and insert: "nongame wildlife designated programs".
                                                                        
 20                                 CORRECTION TO TITLE
 21        On page 1, in line 3, following "PLATES" insert: ", TO REDUCE  THE  AMOUNT
 22    OF FEES CONTRIBUTED TO THE NONGAME WILDLIFE PROGRAM, TO PROVIDE THAT A PORTION
 23    OF FEES SHALL BE CONTRIBUTED TO CERTAIN DESIGNATED PROGRAMS".

  7        affect  wildlife  including,  but  not limited to, brucellosis and chronic
  8        wasting disease.
  9        (c)  The state controller shall annually, by August 1 of each year, trans-
 10        fer an amount equivalent to two dollars and fifty cents  ($2.50)  of  each
 11        initial  cutthroat  wildlife  special plate and one dollar and twenty-five
 12        cents ($1.25) of each renewal cutthroat wildlife plate sold in  the  prior
 13        fiscal  year from the fish and game set-aside account to the department of
 14        parks and recreation fund established in section 67-4225, Idaho Code,  for
 15        the construction and maintenance of nonmotorized boating access facilities
 16        for anglers.";
 17    and  in  line  33,  delete "Notwithstanding the provisions of section 49-402C,
 18    Idaho Code, eEach" and insert: "Each".
                                                                        
 19                                AMENDMENT TO THE BILL

  1    The  provisions  of  this  section shall not apply to the second plate designs
  2    issued pursuant to the provisions of section 49-417, Idaho Code.
  3        (3)  Any redesign required for a special plate to conform with legislative
  4    intent and the provisions of this section may be done in a manner  similar  to
  5    that used to produce the original design.
  6        (4)  The  special plates shall conform in all other respects with the pro-
  7    visions of section 49-443, Idaho Code, relating  to  visibility  requirements,
  8    display of registration number, time period for validity of plates, and reser-
  9    vation of plate numbers.
 10        (5)  No  special  license  plates shall be issued to motor vehicles with a
 11    registered maximum gross weight in  excess  of  twenty-six  thousand  (26,000)
 12    pounds,  or  any motor vehicle registered under section 49-434(5), Idaho Code,
 13    or section 49-435, Idaho Code.
 14        (6)  Following an introductory period of two (2) years  during  which  the
 15    provisions  of  this  subsection  shall not apply, if, for two (2) consecutive
 16    years, fewer than one thousand (1,000) plates are issued per year for  a  spe-
 17    cial license plate program, the department shall so advise the legislature and
 18    assist the legislature in adopting appropriate action to discontinue that spe-
 19    cial license plate program. The provisions of this subsection shall apply only
 20    to special license plate programs created on and after July 1, 1998.
                                                                        
 21        SECTION  3.  This act shall be in full force and effect on and after Janu-
 22    ary 1, 2003.

Statement of Purpose / Fiscal Impact


                 STATEMENT OF PURPOSE

                       RS 11605

This legislation would add a third license plate to the series of 
non-game wildlife license plates. The Idaho Fish and Wildlife 
Foundation, associated with the Department of Fish and Game, began 
the license plate program in 1993. Proceeds from the sale of the 
plate are dedicated to the non-game wildlife program, which manages 
approximately 80% of all the wildlife, fish, and plant species in 
Idaho. This includes numerous species that are either proposed or 
are likely to be proposed for ESA listing. As the number of candidate 
species increases, additional funding is critical if the state hopes 
to preclude additional ESA listings. The Idaho Wildlife Special 
License Plate program provides most of the funds to manage non-game 
wildlife, provides information and conservation education for our 
youth and all citizens, and enhances Idaho’s economy by attracting 
tourists to view our wildlife.



Additional funding would also allow the Department of Fish and 
Game to increase efforts related to aquatic species by providing 
additional resources for monitoring, management and conserving 
non-game fish and other aquatic species. Such efforts are also 
likely to positively impact hunters and anglers by benefitting 
other fish and wildlife, including species that are normally fished 
or hunted.

The plate will feature a rendering of Idaho’s state fish, the 
cutthroat trout. Final approval for the design rests with the Idaho 
Fish and Wildlife Foundation.


                     FISCAL IMPACT



There is no negative fiscal impact.

Initial costs of the program, i.e. programming costs and costs to 
develop the plate design, will be borne by Idaho Fish and Wildlife 
Foundation. The programming costs are estimated to be between $5,720 
and $7,150.

It is estimated that the cutthroat plate will equal the sale of the 
elk plate. Each year, potential sales could bring in an additional 
$300,000 to the Department of Fish and Game’s non-game program and 
approximately $150,000 for the Idaho Transportation Department.
