|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-sixth Legislature Second Regular Session - 2002IN THE SENATE SENATE BILL NO. 1363 BY EDUCATION COMMITTEE 1 AN ACT 2 RELATING TO PUBLIC SCHOOL PUPILS ATTENDING SCHOOL IN ANOTHER STATE; AMENDING 3 SECTION 33-1002E, IDAHO CODE, TO DELETE LANGUAGE WHICH IS IN CONFLICT WITH 4 THE BORDER DISTRICT ALLOWANCE AS CALCULATED PURSUANT TO THE PROVISIONS OF 5 THE EDUCATIONAL SUPPORT PROGRAM. 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. That Section 33-1002E, Idaho Code, be, and the same is hereby 8 amended to read as follows: 9 33-1002E. PUPILS ATTENDING SCHOOL IN ANOTHER STATE. In any school dis- 10 trict which abuts upon the border of another state,andthe resident pupils of 11 said district may attend schools in the other state as provided in section 12 33-1403, Idaho Code, the total number of such pupils shall be considered as13being in attendance in a separate school of their home district, kindergarten,14elementary or secondary as the case may be.
Statement of Purpose RS11684 This legislation amends Section 33-1 002E to delete that portion of the statute that describes students attending school in another state, through a border contract, as if they were students attending a separate school. This section was originally enacted in 1963, for funding purposes, to reimburse school districts for students attending school in another state, as if the students attended a separate school in their home district. The method of crediting Idaho school districts for the cost of contracting with a school districts in another state, described in Section 33-1002E, Idaho Code, was made obsolete and contradictory by subsequent legislation in 1980 and 1994 that specifically includes reimbursement to school districts for border contracts as part of foundation program revisions in state financial support. The allowance in the current funding formula, established in 1994 by Senate Bill 1560, replaced the method described in 33-1002E. It is given at Sections 33-1002(4) and 33-1002(2)(d), Idaho Code.
