That Title 22, Idaho Code, be, and the same is hereby amended 14 by the addition thereto of a NEW CHAPTER, to be known and designated as Chap- 15 ter 51, Title 22, Idaho Code, and to read as follows: 16 CHAPTER 51 17 CARBON SEQUESTRATION ADVISORY COMMITTEE 18 22-5101. LEGISLATIVE INTENT. Increasing levels of carbon dioxide and 19 other greenhouse gases in the atmosphere have led to growing interest in 20 national and international forums for implementing measures to slow and 21 reverse the buildup of such atmospheric constituents. Such measures may poten- 22 tially include the establishment of systems of trading in credits for adoption 23 of practices, technologies or other measures which decrease net emissions of 24 carbon dioxide. Improved agricultural and timber production methods, soil and 25 forest conservation practices and other methods of stewardship of soil and 26 other land resources have great potential to increase carbon sequestration on 27 agricultural and private forest lands and help offset carbon dioxide emissions 28 from other sectors of the economy. It is in the interest of agricultural pro- 29 ducers, nonindustrial private forest landowners and the public in general that 30 the soil conservation commission document and quantify carbon sequestration 31 and greenhouse emissions reductions associated with agricultural and forestry 32 practices, management systems and land uses occurring on cropland, forest land 33 and rangeland in Idaho. It is the intent of the legislature that efforts to 34 quantify and verify carbon sequestration on agricultural and forest lands will 35 enhance the ability of the state's agricultural and nonindustrial private for- 36 est landowners to participate in any system of carbon sequestration marketing 37 or trading. 38 22-5102. CARBON SEQUESTRATION ADVISORY COMMITTEE CREATED -- MEMBERSHIP -- 39 COMPENSATION -- ADMINISTRATIVE ASSISTANCE. (1) The carbon sequestration advi- 40 sory committee is hereby created. The committee shall consist of the following 41 sixteen (16) members, to be appointed by and serve at the pleasure of the gov- 2 1 ernor: 2 (a) The chairman of the soil conservation commission or his designee; 3 (b) The director of the department of agriculture or his designee; 4 (c) The director of the department of environmental quality or his desig- 5 nee; 6 (d) The director of the department of lands or his designee; 7 (e) One (1) member representing the University of Idaho college of agri- 8 culture; 9 (f) One (1) member representing an entity which generates electrical 10 energy; 11 (g) Two (2) members who are producers of field crops, at least one (1) of 12 whom actively employs a minimum tillage management system in his farming 13 operation; 14 (h) Two (2) members who are producers of livestock, at least one (1) of 15 whom is actively involved in implementing a rangeland improvement plan; 16 (i) One (1) member with expertise in carbon sequestration marketing or 17 trading; 18 (j) One (1) member representing soil conservation districts, as defined 19 in section 22-2717, Idaho Code; 20 (k) One (1) member representing the biofuels industry; 21 (l) One (1) member representing the transportation industry; 22 (m) One (1) member representing an environmental protection or conserva- 23 tion organization; and 24 (n) One (1) member representing nonindustrial private forest landowners. 25 (2) Members of the committee shall be compensated as provided in section 26 59-509(b), Idaho Code. 27 (3) The soil conservation commission shall assist the committee with 28 administrative support as reasonably requested by the committee. 29 22-5103. POWERS AND DUTIES OF THE CARBON SEQUESTRATION ADVISORY COMMIT- 30 TEE. The carbon sequestration advisory committee shall: 31 (1) Advise and assist the chairman of the soil conservation commission in 32 preparing the reports required by this chapter and in conducting the assess- 33 ment pursuant to section 22-5105, Idaho Code; 34 (2) Recommend policies or programs to enhance the ability of Idaho agri- 35 cultural and nonindustrial private forest landowners to participate in systems 36 of carbon trading. Such recommendations shall include potential policies or 37 programs designed to optimize economic benefits to agricultural producers and 38 nonindustrial private forest landowners participating in carbon trading trans- 39 actions. Such policies or programs may include, but are not limited to, iden- 40 tifying existing or the potential of creating nonprofit organizations or other 41 public or private entities capable of serving as assemblers of carbon credits 42 or as intermediaries on behalf of producers in carbon trading systems; 43 (3) Encourage the production of educational and advisory materials 44 regarding carbon sequestration on agricultural and forest lands and participa- 45 tion in systems of carbon or greenhouse emissions trading; 46 (4) Identify and recommend areas of research needed to better understand 47 and quantify the processes of carbon sequestration on agricultural and forest 48 lands; 49 (5) Research the development of a greenhouse gas inventory and a mitiga- 50 tion action for the state of Idaho; and 51 (6) Review the carbon sequestration programs and policies of other 52 states. 53 22-5104. REPORTS -- CONTENTS. On or before February 1, 2003, the chairman 3 1 of the soil conservation commission, in consultation with the carbon seques- 2 tration advisory committee, shall prepare a report to the legislature. The 3 report shall include, but not be limited to: 4 (1) The potential for development of a system or systems of carbon emis- 5 sions trading or markets for carbon sequestered on agricultural and forest 6 land; 7 (2) Agricultural and forestry practices, management systems or land uses 8 which increase stored soil carbon; 9 (3) Methods for measuring and modeling net carbon sequestration associ- 10 ated with various agricultural and forestry practices, management systems or 11 land uses occurring on agricultural and forest lands and legislation, if any, 12 to define and protect property rights in and attendant to carbon sequestra- 13 tion; 14 (4) Areas of scientific uncertainty with respect to quantifying and 15 understanding carbon sequestration associated with agricultural and forestry 16 activities; and 17 (5) Any recommendations of the carbon sequestration advisory committee 18 developed pursuant to section 22-5103, Idaho Code. 19 22-5105. POWERS AND DUTIES OF THE CHAIRMAN. (1) In consultation with the 20 carbon sequestration advisory committee, the chairman of the soil conservation 21 commission shall assess agricultural and private forest lands in Idaho for 22 past carbon sequestration and future carbon sequestration potential. The 23 assessment shall seek to quantify carbon sequestration associated with various 24 agricultural and forestry practices, management systems and land uses occur- 25 ring on agricultural and forest lands in this state. On or before March 1, 26 2003, the chairman shall publish a report of the findings. From time to time, 27 the chairman may update the findings as advancements in understanding of the 28 processes of carbon sequestration and new data become available. 29 (2) The assessment shall be conducted in a manner that shall provide a 30 means for owners of agricultural and forest land to estimate past and future 31 net carbon sequestration resulting from agricultural and forestry practices, 32 conservation measures, management systems and land uses occurring on their 33 property. The chairman of the soil conservation commission may contract and 34 cooperate with the natural resources conservation service of the United States 35 department of agriculture to conduct assessment activities provided for in 36 this section. 37 (3) The soil conservation commission may apply for and accept grants, 38 gifts or other sources of public and private funds to carry out the purposes 39 of this chapter. 40 22-5106. CARBON SEQUESTRATION ASSESSMENT FUND CREATED. There is hereby 41 created and established in the state treasury a fund to be known as the 42 "Carbon Sequestration Assessment Fund," which shall consist of such funds as 43 may be appropriated for that purpose by the legislature, grants, donations or 44 moneys from other sources. The fund shall be administered by the soil conser- 45 vation commission in order to carry out the purposes of this chapter. Moneys 46 in the fund may be expended pursuant to appropriation. Any interest earned on 47 the investment of idle moneys in the fund shall be returned to the fund.

STATEMENT OF PURPOSE RS ll7l8Cl The purpose of this legislation is to create a carbon sequestration advisory committee. This committee will identify and recommend policies and programs dealing with carbon trading for agricultural lands that will enhance the ability of the landowners to offset carbon emissions from other sectors of the economy. This program could be very beneficial for agricultural landowners. The Director of Agriculture, in consultation with the carbon sequestration advisory committee, will provide a number of reports to the legislature. Idaho is one of the few remaining states in the U.S. to develop a climate change program and develop a greenhouse gas inventory. All the states bordering Idaho (with the exception of Wyoming) have developed greenhouse gas inventories and are currently evaluating ways to manage their emissions. There is a direct link between the reduction of greenhouse gases and EPA listed emissions. FISCAL IMPACT The fiscal impact will be the compensation of the members of the committee as provided in Idaho Code 59-509(b).
