  1                                        AN ACT
  2    RELATING TO TEACHERS; AMENDING CHAPTER 12, TITLE 33, IDAHO CODE, BY THE  ADDI-
  3        TION OF A NEW SECTION 33-1280, IDAHO CODE, TO PROVIDE FOR  THE  AUTHORIZA-
  4        TION OF AMERICAN INDIAN LANGUAGES TEACHERS AND TO SET FORTH PROCEDURES FOR
  5        DESIGNATION  BY INDIAN TRIBES AND AUTHORIZATION BY THE STATE BOARD OF EDU-
  6        CATION.
                                                                        
  7    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  8        SECTION 1.  That Chapter 12, Title 33, Idaho Code, be,  and  the  same  is
  9    hereby  amended by the addition thereto of a NEW SECTION, to be known and des-
 10    ignated as Section 33-1280, Idaho Code, and to read as follows:
                                                                        
 11        33-1280.  AMERICAN INDIAN LANGUAGES TEACHING AUTHORIZATION. (1) As used in
 12    this section, "Indian tribe" is as defined in section 67-4001, Idaho Code.
 13        (2)  It is the policy of the state of Idaho to preserve, protect and  pro-
 14    mote  the  rights  of  Indian tribes to use, practice and develop their native
 15    languages and to encourage American Indians in the state  to  use,  study  and
 16    teach their native languages in order to encourage and promote:
 17        (a)  The survival of the native language;
 18        (b)  Increased student scholarship;
 19        (c)  Increased student awareness of the student's culture and history; and
 20        (d)  Increased student success.
 21        (3)  The state board of education shall promulgate rules authorizing Amer-
 22    ican Indian languages teachers to teach in the public schools of this state.
 23        (4)  Each  Indian  tribe  may  establish its own system of designation for
 24    individuals qualified to teach that tribe's native language.  In  establishing
 25    such a system, the tribe shall determine:
 26        (a)  The development of an oral and written qualification test;
 27        (b)  Which dialects shall be used in the test;
 28        (c)  Whether the tribe will standardize the tribe's writing system;
 29        (d)  How the teaching methods will be evaluated in the classroom; and
 30        (e)  The period of time for which a tribal designation shall be valid.
 31        (5)  (a) Each  Indian  tribe shall provide to the state board of education
 32        the names of those highly and uniquely qualified individuals who have been
 33        designated to teach the tribe's native language.
 34        (b)  Upon receiving the names of American Indian languages teachers desig-
 35        nated by an Indian tribe, the state board  of  education  shall  authorize
 36        those individuals as American Indian languages teachers in accordance with
 37        rules of the board.
 38        (6)  Notwithstanding any other provision of law, the state board of educa-
 39    tion  shall  not require an American Indian languages teacher who has obtained
 40    tribal designation to teach a native language  to  hold  a  specific  academic
 41    degree or to complete a teacher education program.
 42        (7)  (a) An American Indian languages teaching authorization shall qualify
 43        the  authorized  individual to accept a teaching position or assignment in

  1        any school district of the state that offers  or  permits  courses  in  an
  2        American Indian language.
  3        (b)  A  holder  of an American Indian languages teaching authorization who
  4        does not also have a teaching certificate as provided in section  33-1201,
  5        Idaho  Code,  may not teach in a school district of this state any subject
  6        other than the American Indian language for which he or she is  authorized
  7        to teach.

Statement of Purpose / Fiscal Impact


	             STATEMENT OF PURPOSE
                           RS 11980

This legislation states that it is the policy of the State of 
Idaho to preserve and protect native languages in the State and 
with Indian Tribes creates a government-to-government process for 
the authorization and designation of qualified individuals to teach 
American Indian languages in public schools. The bill directs the 
Board of Education to promulgate rules specifying the details of the 
process.

An American Indian language teaching authorization will qualify the 
holder to accept a teaching position or assignment in any school 
district that chooses to offer or permit courses in an American 
Indian language. Individuals holding such authorization may not 
teach other subjects unless they also hold a regular teaching 
certificate.
