|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-sixth Legislature Second Regular Session - 2002IN THE SENATE SENATE BILL NO. 1435 BY RESOURCES AND ENVIRONMENT COMMITTEE 1 AN ACT 2 RELATING TO MINIMUM STREAM FLOWS; AMENDING CHAPTER 17, TITLE 42, IDAHO CODE, 3 BY THE ADDITION OF A NEW SECTION 42-1765B, IDAHO CODE, TO ALLOW THE WATER 4 RESOURCE BOARD TO APPOINT A LOCAL RENTAL COMMITTEE TO FACILITATE OPERATION 5 OF THE WATER SUPPLY BANK FOR THE RENTAL OF NATURAL FLOW RIGHTS WITHIN A 6 RIVER BASIN AND TO PROVIDE FOR USE OF THE WATER SUPPLY BANK. 7 Be It Enacted by the Legislature of the State of Idaho: 8 SECTION 1. That Chapter 17, Title 42, Idaho Code, be, and the same is 9 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 10 ignated as Section 42-1765B, Idaho Code, and to read as follows: 11 42-1765B. LOCAL COMMITTEES -- RENTAL OF NATURAL FLOW WATER. (1) The water 12 resource board may appoint a local rental committee to facilitate operation of 13 the water supply bank for the rental of natural flow water rights within a 14 river basin comprised of a river and all tributary water sources. The provi- 15 sions of section 42-1765, Idaho Code, and the board's water supply bank rules 16 shall apply to the operation of the water supply bank in the river basin, 17 except as inconsistent with this section. 18 (2) When so appointed under the provisions of this section, the local 19 rental committee for the river basin shall have authority to rent natural 20 flow water rights between consenting owners and consenting renters. 21 (3) Rights to the use of water for a portion of the approved period of 22 use under a water right may be accepted into the water supply bank and rented 23 out, provided the owner demonstrates to the satisfaction of the director that 24 there will be an equivalent reduction in the extent of beneficial use made 25 under the right.
AMENDED STATEMENT OF PURPOSE RS 12O48C1 The purpose of this measure would be to enhance fish and wildlife resources. This measure would allow the water resource board to appoint a local water rental committee to facilitate the operation of a water supply bank within a river basin. The local water rental committee shall have the authority to rent natural flow water rights between consulting owners and renters. FISCAL IMPACT There would be no cost to state or local government or any subdivision thereof. Any money that may be needed for programs would be raised locally. Any funds needed to rent water for the benefit of fish and wildlife would come from non-governmental sources. Contact Name: Sen.
