|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-sixth Legislature Second Regular Session - 2002IN THE SENATE SENATE BILL NO. 1452 BY STATE AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO PUBLIC EMPLOYEE RETIREMENT BENEFITS; AMENDING CHAPTER 13, TITLE 3 59, IDAHO CODE, BY THE ADDITION OF A NEW SECTION 59-1366, IDAHO CODE, TO 4 REQUIRE THAT RIGHTS TO HEALTH INSURANCE COVERAGE BE MAINTAINED. 5 Be It Enacted by the Legislature of the State of Idaho: 6 SECTION 1. That Chapter 13, Title 59, Idaho Code, be, and the same is 7 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 8 ignated as Section 67-1366, Idaho Code, and to read as follows: 9 59-1366. INSURANCE RIGHTS TO BE EXTENDED. A health insurance program or 10 options in effect for a retired member and his or her spouse at the time of 11 death of the retired member shall, at the option of the surviving spouse, be 12 continued in effect at the cost of the spouse, until he or she reaches the age 13 of sixty-five (65) years.
STATEMENT OF PURPOSE RS 12019 This legislation is for those eligible for coverage under the State's health insurance program. It would extend coverage beyond the 36-month cobra on the same terms and with the same conditions for the spouse and adult dependent children of a state retiree should the retiree precede them in death. It would require that spouse and/or dependent bear the full cost of that coverage. FISCAL IMPACT At tHe time this legislation would go into effect, the spouse or adult dependent would be bearing the full cost of the health insurance so that there would be no cost to the general fund.
