|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-sixth Legislature Second Regular Session - 2002IN THE SENATE SENATE BILL NO. 1461 BY STATE AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO THE INFORMATION TECHNOLOGY RESOURCE MANAGEMENT COUNCIL; AMENDING 3 SECTION 67-5745C, IDAHO CODE, TO REVISE THE GENERAL POWERS AND DUTIES OF 4 THE COUNCIL. 5 Be It Enacted by the Legislature of the State of Idaho: 6 SECTION 1. That Section 67-5745C, Idaho Code, be, and the same is hereby 7 amended to read as follows: 8 67-5745C. GENERAL POWERS AND DUTIES OF THE COUNCIL. The council shall: 9 (1) Review and evaluate the information technology and telecommunications 10 systems presently in use by state agencies; 11 (2)Recommend policies and pPrepare statewide short-range and long-range 12 information technology and telecommunications systems plans to meet the needs 13 of state agencies; 14 (3) Within the context of its strategic plans, establish statewide infor- 15 mation technology and telecommunications policies, standards, guidelines, con- 16 ventions and comprehensive risk assessment criteria that will assure uniform- 17 ity and compatibility of such systems within state agencies; 18 (4) Recommend and coordinate the use and application of state agencies' 19 information technology and telecommunications resources; 20 (5) Review and approve large-scale information technology and telecommu- 21 nications projects including, but not limited to, risk assessment 22 methodologies used by state agencies using council risk assessment criteria, 23 for state agencies; 24 (6) Review state agencies' compliance with statewide information technol- 25 ogy and telecommunications systems plans; 26 (7) Recommend cost-efficient procedures for state agencies' acquisition 27 and procurement of information technology and telecommunications systems; 28 (8) Upon request, provide technical expertise to state government and any 29 other governmental entity; 30 (9) Maintain a continuous and comprehensive inventory of information 31 technology and telecommunications systems within state agencies; 32 (10) In accordance with statutes governing the availability or confidenti- 33 ality of public records and information, establish guidelines for the acces- 34 sing of public information by the public; 35 (11) On an annual basis, publish a report of the activities of the council 36 for provision to the governor and the legislature; 37 (12) Recommend the enactment or promulgation of any statutes or rules nec- 38 essary to carry out the statewide information technology and telecommunica- 39 tions systems plans; 40 (13) Enter into contracts for professional services and assistance not 41 otherwise available in state government; 42 (14) Encourage and promote the development and growth of the information 43 technology industry in the state in accordance with sound business principles 2 1 and practices; 2 (15) Encourage and promote cooperative information technology efforts and 3 activities between the state, private enterprise and the public; 4 (16) Encourage and support education and training opportunities relating 5 to information technology and telecommunications; and 6 (17) Perform any additional functions consistent with the purpose of this 7 act which are necessary and appropriate for the proper conduct of the council.
STATEMENT OF PURPOSE RS 12088C1 This legislation removes outdated "recommend" language regarding the powers of the Information Technology Resource Management Council (ITRMC). ITRMC has the responsibility and must have clear authority to establish and maintain efficient and uniform statewide standards and policies for information technology. FISCAL IMPACT This legislation has no fiscal impact as it merely conforms the law to the current duties and activities of ITRMC.
