  1                                        AN ACT
  2    RELATING TO ADOPTION OF THE UNIFORM FIRE CODE; AMENDING SECTION 41-253,  IDAHO
  3        CODE,  TO  AUTHORIZE THE BOARD OF COUNTY COMMISSIONERS TO ADOPT AMENDMENTS
  4        TO THE CODE FOR CERTAIN FACILITIES AND TO MAKE A TECHNICAL CORRECTION.
                                                                        
  5    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  6        SECTION 1.  That Section 41-253, Idaho Code, be, and the  same  is  hereby
  7    amended to read as follows:
                                                                        
  8        41-253.  STATEMENT  OF  PURPOSE  -- ADOPTION OF UNIFORM FIRE CODE. (1) The
  9    purpose of this act is to protect human life from fire, and to prevent  fires.
 10    This  act is intended to prescribe regulations consistent with nationally rec-
 11    ognized good practice for the safeguarding of life and property  from  hazards
 12    of  fire and explosion arising from the storage, handling and use of hazardous
 13    substances, materials, and devices, and from conditions hazardous to  life  or
 14    property in the use or occupancy of buildings or premises, and there is hereby
 15    adopted the "Uniform Fire Code,", 1979 edition, with the 1981 supplement, with
 16    appendices  thereto,  published by the Western Fire Chiefs Association and the
 17    International Conference of Building Officials and such later editions as  may
 18    be  so  published  and adopted by the state fire marshal, as the minimum stan-
 19    dards for the protection of life and property from fire and explosions in  the
 20    state of Idaho.
 21        (2)  For  the  purposes of this act the "uniform fire code" shall mean the
 22    publications as adopted under subsection (1) of this section.
 23        (3)  A board of county commissioners may  amend  provisions  of  the  code
 24    adopted  in  this  section  as  it applies to short term events held at county
 25    fairgrounds or other county facilities located within the county.

                      STATEMENT OF PURPOSE

                          RS 12115
                              
                              
The purpose of this bill is to provide county commissioners
with the ability to provide uniformity and predictability
regarding the enforcement of fire safety codes which affect,
among others, charitable and non-profit fundraising vendors at
county fairgrounds and special events.


                       FISCAL IMPACT
                              
There is no fiscal impact on the state general fund and
minimal impact on county government depending on the adoption of
ordinances and the cost of inspections.
