|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-sixth Legislature Second Regular Session - 2002IN THE SENATE SENATE BILL NO. 1476 BY JUDICIARY AND RULES COMMITTEE 1 AN ACT 2 RELATING TO REQUIREMENTS FOR MAINTENANCE OF SCHOOL BUILDINGS; AMENDING CHAPTER 3 10, TITLE 33, IDAHO CODE, BY THE ADDITION OF A NEW SECTION 33-1018, IDAHO 4 CODE, TO REQUIRE AN ALLOCATION BY SCHOOL DISTRICTS FOR BUILDING MAINTE- 5 NANCE, TO CREATE A FUND, SPECIFY A LIMIT AND GOVERN USES OF THE FUND; AND 6 PROVIDING AN EFFECTIVE DATE. 7 Be It Enacted by the Legislature of the State of Idaho: 8 SECTION 1. That Chapter 10, Title 33, Idaho Code, be, and the same is 9 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 10 ignated as Section 33-1018, Idaho Code, and to read as follows: 11 33-1018. ALLOCATION FOR BUILDING MAINTENANCE REQUIRED. School districts 12 shall annually deposit funds from any source available to the district equal 13 to at least one and one-half percent (1.5%) of the replacement value of all 14 district owned buildings occupied by students to a deferred maintenance fund. 15 However, no deposits are required beyond those necessary to bring the balance 16 in the deferred maintenance fund to an amount representing three percent (3%) 17 of the replacement value of all district owned buildings occupied by students. 18 Moneys in a school district's deferred maintenance fund shall be used exclu- 19 sively for the maintenance and repair of the district owned buildings and 20 building systems that are occupied by students, the expenditures of which are 21 categorized as maintenance of buildings and equipment on forms prescribed by 22 the state department of education. Unexpended moneys in a school district's 23 deferred maintenance fund shall be carried over from year to year. The 24 replacement value of all district owned buildings that are occupied by stu- 25 dents shall be determined by multiplying the number of square feet of building 26 floor space in all district owned buildings that are occupied by students by 27 seventy-three dollars and twenty-five cents ($73.25). The joint finance- 28 appropriations committee shall annually review the replacement value per 29 square foot when setting appropriations for the educational support program, 30 and may make adjustments of this figure as necessary. School districts shall 31 annually submit the following to the state department of education: 32 (1) An update of the number of square feet of building floor space in 33 district owned buildings occupied by students; 34 (2) A report showing the funds and fund sources deposited into the 35 district's deferred maintenance fund in each fiscal year, the fund balance 36 carried forward from the prior fiscal years, and the amount and categories of 37 expenditures from the fund. 38 SECTION 2. This act shall be in full force and effect on and after July 39 1, 2003.
STATEMENT OF PURPOSE RS 12142 The purpose of this legislation is to require school districts to spend or deposit in an account, specific funds calculated by formula for the purpose of maintaining occupied school district owned buildings. Additionally, it provides for a three percent (3%) cap of the replacement value in the deferred maintenance fund.
