1 AN ACT
2 APPROPRIATING MONEYS TO THE DEPARTMENT OF HEALTH AND WELFARE FOR THE DIVISION
3 OF WELFARE FOR FISCAL YEAR 2003; PROVIDING THAT THE STATE CONTROLLER SHALL
4 MAKE TRANSFERS FROM THE GENERAL FUND; REAPPROPRIATING CERTAIN UNEXPENDED
5 AND UNENCUMBERED BALANCES OF MONEYS; AUTHORIZING THE EXPENDITURE OF ALL
6 RECEIPTS COLLECTED; EXPRESSING LEGISLATIVE INTENT WITH REGARD TO SALARY
7 SAVINGS; EXPRESSING LEGISLATIVE INTENT WITH REGARD TO REINSTATEMENT OF
8 WELFARE FRAUD INVESTIGATORS; APPROPRIATING ADDITIONAL MONEYS TO THE
9 DEPARTMENT OF HEALTH AND WELFARE FOR THE SELF-RELIANCE PROGRAMS FOR FISCAL
10 YEAR 2002; AND DECLARING AN EMERGENCY FOR SECTION 7 OF THIS ACT.
11 Be It Enacted by the Legislature of the State of Idaho:
12 SECTION 1. There is hereby appropriated to the Department of Health and
13 Welfare for the Division of Welfare, the following amounts to be expended for
14 the designated programs according to the designated expense classes from the
15 listed funds for the period July 1, 2002, through June 30, 2003:

39 SECTION 2. As appropriated, the State Controller shall make transfers of
40 the General Fund to the Cooperative Welfare Fund, periodically, as requested
41 by the Director of the Department of Health and Welfare and approved by the
42 Board of Examiners.

1 SECTION 3. There is hereby reappropriated to the Department of Health and
2 Welfare any unexpended and unencumbered balances of the Cooperative Welfare
3 Fund as appropriated for fiscal year 2002, to be used for nonrecurring expen-
4 ditures only for the period July 1, 2002, through June 30, 2003. The reappro-
5 priation shall be computed by the Department of Health and Welfare from avail-
6 able moneys.
7 SECTION 4. Notwithstanding the provisions of Section 67-3516(2), Idaho
8 Code, the Department of Health and Welfare is hereby authorized to expend all
9 receipts collected as noncognizable funds for the period July 1, 2002, through
10 June 30, 2003.
11 SECTION 5. Notwithstanding the provisions of Section 67-3511(1), Idaho
12 Code, it is hereby declared to be the intent of the Idaho Legislature that the
13 appropriation for personnel costs, as contained in Section 1 of this act,
14 shall be utilized only for personnel costs for the period July 1, 2002,
15 through March 1, 2003, which the Legislature intends will result in salary
16 savings. It is further legislative intent that carryover funds from fiscal
17 year 2002 shall be available for nonrecurring expenditures other than salaries
18 during fiscal year 2003. It is further legislative intent that in January
19 2003, the Department shall make a written report to the Joint Finance-
20 Appropriations Committee regarding its salary savings and expenditures for
21 operating expenses and capital outlay during the first half of the fiscal year
22 2003. Salary savings during fiscal year 2003 will be available to the Depart-
23 ment for object transfers for the purposes set out in Section 67-3511(1),
24 Idaho Code, only upon consent of the Joint Finance-Appropriations Committee
25 during the First Regular Session of the Fifty-seventh Idaho Legislature.
26 SECTION 6. It is hereby declared to be the intent of the Idaho Legisla-
27 ture that welfare fraud investigators be reinstated in each region of the
28 state with at least one per each region.
29 SECTION 7. In addition to the appropriation made in Section 1, Chapter
30 369, Laws of 2001, there is hereby appropriated to the Department of Health
31 and Welfare for the Self-Reliance Programs the following amounts to be
32 expended according to the designated expense class from the listed fund for
33 the period July 1, 2001, through June 30, 2002:

40 SECTION 8. An emergency existing therefor, which emergency is hereby

This is an appropriation to the Department of Health and Welfare for the Division of Welfare for fiscal year 2002-03. Section 1 of the bill appropriates $107,614,400 for the Self-Reliance Programs and $15,154,800 for TAFI and AABD Benefit Payments for a grand total of $122,769,200 for fiscal year 2003. Section 7 of the bill is a supplemental appropriation in the amount of $300,000 for fiscal year 2002 to cover Child Support Enforcement legal costs.
