  1                                        AN ACT
  2    RELATING TO SALARIES OF ELECTIVE  OFFICERS;  AMENDING  SECTION  59-501,  IDAHO
  3        CODE, TO PROVIDE THAT THE SALARIES OF ELECTIVE OFFICERS SHALL BE INCREASED
  4        BY  SPECIFIED  AMOUNTS  ON THE FIRST MONDAY OF JANUARY OF THE YEARS SPECI-
  5        FIED.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION 1.  That Section 59-501, Idaho Code, be, and the  same  is  hereby
  8    amended to read as follows:
                                                                        
  9        59-501.  SALARIES OF STATE ELECTIVE OFFICERS -- REGULAR PAYMENT -- TRAVEL-
 10    ING EXPENSES -- FEES PROPERTY OF STATE. (1) The governor, lieutenant governor,
 11    secretary  of  state,  state controller, state treasurer, attorney general and
 12    superintendent of  public  instruction  shall,  during  their  continuance  in
 13    office, receive for their services compensation as follows:
 14        Commencing  on the first Monday in January 1999, until the first Monday in
 15    January 2000:
 16        Governor, $92,500 per annum;
 17        Lieutenant governor, $24,500 per annum;
 18        Secretary of state, $75,000 per annum;
 19        State controller, $75,000 per annum; said salary to be audited by the leg-
 20    islative council;
 21        Attorney general, $82,500 per annum;
 22        State treasurer, $75,000 per annum; and
 23        State superintendent of public instruction, $75,000 per annum.
 24        Commencing on the first Monday in January 2000, until the first Monday  in
 25    January 2001:
 26        Governor, $95,500 per annum;
 27        Lieutenant governor, $25,250 per annum;
 28        Secretary of state, $77,500 per annum;
 29        State controller, $77,500 per annum; said salary to be audited by the leg-
 30    islative council;
 31        Attorney general, $85,500 per annum;
 32        State treasurer, $77,500 per annum; and
 33        State superintendent of public instruction, $77,500 per annum.
 34        Commencing  on the first Monday in January 2001, until the first Monday in
 35    January 2002:
 36        Governor, $98,500 per annum;
 37        Lieutenant governor, $26,000 per annum;
 38        Secretary of state, $80,000 per annum;
 39        State controller, $80,000 per annum; said salary to be audited by the leg-
 40    islative council;
 41        Attorney general, $88,500 per annum;
 42        State treasurer, $80,000 per annum; and
 43        State superintendent of public instruction, $80,000 per annum.

  1        Commencing on the first Monday in January 2002, until the first Monday  in
  2    January 20034:
  3        Governor, $101,500 per annum;
  4        Lieutenant governor, $26,750 per annum;
  5        Secretary of state, $82,500 per annum;
  6        State controller, $82,500 per annum; said salary to be audited by the leg-
  7    islative council;
  8        Attorney general, $91,500 per annum;
  9        State treasurer, $82,500 per annum; and
 10        State superintendent of public instruction, $82,500 per annum.
 11        Commencing  on the first Monday in January 2004, until the first Monday in
 12    January 2005:
 13        Governor, $104,545 per annum;
 14        Lieutenant governor, $27,553 per annum;
 15        Secretary of state, $84,975  per annum;
 16        State controller, $84,975 per annum; said salary to be audited by the leg-
 17    islative council;
 18        Attorney general, $94,245 per annum;
 19        State treasurer, $84,975 per annum; and
 20        State superintendent of public instruction, $84,975 per annum.
 21        Commencing on the first Monday in January 2005, until the first Monday  in
 22    January 2006:
 23        Governor, $107,681  per annum;
 24        Lieutenant governor, $28,379 per annum;
 25        Secretary of state, $87,524 per annum;
 26        State  controller,  $87,524   per  annum; said salary to be audited by the
 27    legislative council;
 28        Attorney general, $97,072 per annum;
 29        State treasurer, $87,524 per annum; and
 30        State superintendent of public instruction, $87,524 per annum.
 31        Commencing on the first Monday in January 2006, until the first Monday  in
 32    January 2007:
 33        Governor, $110,912 per annum;
 34        Lieutenant governor, $29,231  per annum;
 35        Secretary of state, $90,150  per annum;
 36        State  controller,  $90,150   per  annum; said salary to be audited by the
 37    legislative council;
 38        Attorney general, $99,985  per annum;
 39        State treasurer, $90,150  per annum; and
 40        State superintendent of public instruction, $90,150  per annum.
 41        (2)  Such compensation shall be paid on regular pay periods as due out  of
 42    the  state  treasury,  and  shall be in full for all services by said officers
 43    respectively rendered in any official capacity or employment  whatever  during
 44    their  respective terms of office; but no increase in the rate of compensation
 45    shall be made during the terms of such officers; provided, however,  that  the
 46    actual  and necessary expenses of the governor, lieutenant governor, secretary
 47    of state, attorney general, state controller, state  treasurer,  and  superin-
 48    tendent  of  public  instruction  while traveling within the state, or between
 49    points within the state, in the  performance  of  official  duties,  shall  be
 50    allowed  and  paid  by  the state; not however, exceeding such sum as shall be
 51    appropriated for such purpose.
 52        (3)  Actual and necessary  subsistence  expenses  of  the  governor  while
 53    traveling  in  connection  with  the performance of official duties are hereby
 54    expressly exempted from the provisions of sections 67-2007 and 67-2008,  Idaho
 55    Code. (Standard Travel Pay and Allowance Act of 1949).

  1        (4)  No  officer  named in this section shall receive, for the performance
  2    of any official duty any fee for his own use, but all fees fixed  by  law  for
  3    the performance by either of them, of any official duty, shall be collected in
  4    advance and deposited with the state treasurer to the credit of the state.

Statement of Purpose / Fiscal Impact


                    STATEMENT OF PURPOSE
                          RS12170


This legislation provides a salary adjustment for statewide elected 
officials as follows:

        January 1, 2003 - no increase

	January 1, 2004 - 3% increase

	January 1, 2005 - 3% increase

	January 1, 2006 - 3% increase 

Statewide elected official salaries must be set prior to the
beginning of their next term of office, and cannot be changed during 
their term of office.


                       FISCAL IMPACT


There is no fiscal impact to the general fund in fiscal year 2003.

The fiscal impact to the general fund in fiscal year 2004 would be
$9,800.


The fiscal impact to the general fund in fiscal year 2005 would be
$19,600.


The fiscal impact to the general fund in fiscal year 2006 would be
$19,900.

The fiscal impact to the general fund in fiscal year 2007 would be
$10,100.
