  1                                        AN ACT
  2    APPROPRIATING MONEYS TO THE LEGISLATIVE ACCOUNT FROM THE  STATE  LOTTERY  FUND
  3        FOR  RETAINING  A CONSULTANT TO STUDY AND REPORT TO THE LEGISLATURE ON THE
  4        ECONOMIC AND SOCIAL EFFECTS OF GAMBLING AND GAMING; AND DECLARING AN EMER-
  5        GENCY.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION 1.  There  is  hereby  appropriated  to  the  Legislative  Account
  8    $60,000 from the State Lottery Fund created pursuant to Section 67-7428, Idaho
  9    Code,  to  be  expended for the period on and after the effective date of this
 10    act until June 30, 2004, and shall be utilized to retain a consultant or  con-
 11    sultants  to  study the economic and social effects of gambling and gaming and
 12    to make a report of such study to the Legislature.  Notwithstanding any  other
 13    provision  of law to the contrary, any unexpended moneys appropriated pursuant
 14    to this act need not be encumbered at the end of the fiscal year.
                                                                        
 15        SECTION 2.  An emergency existing  therefor,  which  emergency  is  hereby
 16    declared to exist, this act shall be in full force and effect on and after its
 17    passage and approval.

Statement of Purpose / Fiscal Impact


                         STATEMENT OF PURPOSE

Idaho voters adopted HJR No. 4 in 1992 that legalized and limited 
gambling in Idaho to (a) a State lottery, (b) pan-mutual betting 
and (c) raffle games that are operated by qualified charitable
organizations in pursuit of charitable purposes. As a result of the 
legalization of these types of gambling, Casino type gambling is 
being offered under various venues across Idaho and expansions of 
casino type gambling has been requested and is, in fact, to be 
placed before the voters via an initiative sponsored by two North 
Idaho Tribes. Some businesses in Ada County are now in court to 
determine if the machines they are using are legal.

State lottery net proceeds have been decreasing, resulting in 
decreased funding to public education and State buildings. This 
raises questions about the competitive impact such expanded types 
of gambling will have on the state lottery, and the amount of net 
proceeds available for distribution to state lottery beneficiaries.

The National Gambling Impact Study Commission recommended "a 
national moratorium on gambling expansion to allow policymakers to 
demand more information   such as comprehensive and objective 
cost/benefit analysis - in order to assist policymakers in making 
decisions in the public interest." However, gambling has continued 
to expand in Idaho and no Idaho study has been performed to measure 
the economic and social cost/benefit evaluation. With 10 years of 
experience since limited gambling was legalized in Idaho, it would 
seem prudent to engage such a study.

This bill will direct an amount of money to pay for a cost/benefit 
evaluation of the economic and social costs of gambling in Idaho. 
A task force will be formed to locate and recommend a qualified
researcher(s) to perform such an evaluation.

There is an emergency clause to enable the evaluation to quickly 
move ahead to provide timely information to Idaho citizens and to 
the Legislature.


                     FISCAL IMPACT:
                            
There is no fiscal impact to the General Fund. $60,000 has been 
appropriated from dedicated lottery proceeds.
