  1                                        AN ACT
  2    APPROPRIATING MONEYS FOR THE IDAHO EDUCATIONAL PUBLIC BROADCASTING SYSTEM  FOR
  3        FISCAL  YEAR  2003; LIMITING THE NUMBER OF FULL-TIME EQUIVALENT POSITIONS;
  4        AND EXPRESSING LEGISLATIVE INTENT  WITH  REGARD  TO  DIGITAL  BROADCASTING
  5        UPGRADES.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION  1.  There  is hereby appropriated to the State Board of Education
  8    for the Idaho Educational Public Broadcasting System the following amounts  to
  9    be  expended according to the designated expense classes from the listed funds
 10    for the period July 1, 2002, through June 30, 2003:

 20        SECTION 2.  In accordance with Section 67-3519, Idaho Code, the Idaho Edu-
 21    cational Public Broadcasting System is authorized  no  more  than  thirty-five
 22    (35)  full-time equivalent positions to be funded by the appropriation in Sec-
 23    tion 1 of this act, at any point during the period July 1, 2002, through  June
 24    30,  2003,  unless specifically authorized by the Governor. The Joint Finance-
 25    Appropriations Committee will be notified promptly of any increased  positions
 26    so authorized.
                                                                        
 27        SECTION 3.  It is legislative intent that Idaho Public Television meet the
 28    federally-imposed  mandate  of  broadcasting  a digital signal by May 2003. To
 29    this end, any unspent moneys appropriated for  digital  broadcasting  upgrades
 30    during the period July 1, 2001, through June 30, 2002, shall be encumbered for
 31    the  purposes  of  completing the final phase of digital broadcasting upgrades
 32    during the period July 1, 2002, through  June  30,  2003.  This  appropriation
 33    acknowledges  that additional federal grant funds may become available to sup-
 34    port the final phase of  digital  broadcasting  upgrades.  It  is  legislative
 35    intent  that  Idaho  Public  Television seek such funds to supplement, and, if
 36    possible, replace General Fund moneys appropriated  for  digital  broadcasting
 37    upgrades by this act.

The FY 2003 appropriation for Idaho Public Television includes an 11.6% base reduction, and eliminates four positions. One of the four positions eliminated is a position created by the 2001 Legislature that was never filled, due to holdbacks. Personnel cost rollups provides funding for cost increases in the state employee medical insurance plan. Non-Standard Adjustments include minor adjustments in interagency billing costs. Replacement Items includes funding for the third phase of Idaho Public Television’s federally-mandated upgrade to digital broadcasting technology.
