|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-sixth Legislature Second Regular Session - 2002IN THE SENATE SENATE JOINT MEMORIAL NO. 110 BY JUDICIARY AND RULES COMMITTEE 1 A JOINT MEMORIAL 2 TO THE SENATE AND HOUSE OF REPRESENTATIVES OF THE UNITED STATES IN CONGRESS 3 ASSEMBLED, AND TO THE CONGRESSIONAL DELEGATION REPRESENTING THE STATE OF 4 IDAHO IN THE CONGRESS OF THE UNITED STATES. 5 We, your Memorialists, the Senate and the House of Representatives of the 6 State of Idaho assembled in the Second Regular Session of the Fifty-sixth 7 Idaho Legislature, do hereby respectfully represent that: 8 WHEREAS, in the year 1890, Idaho was admitted to the Union and Congress 9 created the District of Idaho and soon thereafter appointed Idaho's first 10 United States District Judge for the District of Idaho. A second judgeship was 11 created in the year 1954. Since that time, Congress has not approved any new 12 district judicial positions for the District of Idaho; and 13 WHEREAS, in the year 1954, the resident population of the state of Idaho 14 was roughly 600,000. Based on the year 2000 census, the current population of 15 the state of Idaho has climbed to 1,293,953 residents; and 16 WHEREAS, Idaho's United States District Judges are required to travel 17 throughout the state of Idaho to conduct hearings and trials in both civil and 18 criminal cases. The two judges hear cases in the four distant authorized loca- 19 tions including Coeur d'Alene and Moscow situated in northern Idaho and Poca- 20 tello and Boise located in southern Idaho; and 21 WHEREAS, the number of civil and criminal cases has increased signifi- 22 cantly since 1954, placing a burden on our judges and court system. In the 23 year 2001, a total of 852 cases were filed in Idaho's United States District 24 Court; and 25 WHEREAS, given the population growth in the state of Idaho, the concurrent 26 increase in cases filed in our United States District Court, and the logisti- 27 cal difficulty posed by our judges conducting proceedings in the far reaching 28 areas of our state, the addition of a third United States District Judge for 29 the state of Idaho is imperative. 30 NOW, THEREFORE, BE IT RESOLVED that the members of the Second Regular Ses- 31 sion of the Fifty-sixth Idaho Legislature, the Senate and the House of Repre- 32 sentatives concurring therein, hereby respectfully urge the Congress of the 33 United States to authorize an additional United States District Court Judge 34 and commensurate staff for the District of Idaho to assist in handling current 35 and anticipated caseloads in the District of Idaho; and 36 BE IT FURTHER RESOLVED that the Secretary of the Senate be, and she is 37 hereby authorized and directed to forward a copy of this Memorial to the Pres- 38 ident of the Senate and the Speaker of the House of Representatives of Con- 39 gress, and the congressional delegation representing the State of Idaho in the 40 Congress of the United States.
STATEMENT OF PURPOSE RS 11744 The purpose of the Senate Joint Memorial is to urge Congress to authorize and fund a third United States District Court Judge for the District of Idaho together with an appropriate and ancillary support staff.
