1 AN ACT
2 RELATING TO RECORDING OF SURVEYS; AMENDING SECTION 55-1902, IDAHO CODE, TO
3 INCLUDE A DEFINITION OF "BASIS OF BEARING"; AND AMENDING SECTION 55-1906,
4 IDAHO CODE, TO CLARIFY REQUIRED CONTENTS OF RECORDS OF SURVEY.
5 Be It Enacted by the Legislature of the State of Idaho:
6 SECTION 1. That Section 55-1902, Idaho Code, be, and the same is hereby
7 amended to read as follows:
8 55-1902. DEFINITIONS. As used in this chapter:
9 (1) "Basis of bearing" means the bearing in degrees, minutes and seconds,
10 or equivalent, of a line between two (2) monuments or corners which serves as
11 the reference bearing for all other lines on the survey.
12 (2) "Corner" unless otherwise defined, means a property corner, or a
13 property controlling corner, or a public land survey corner, or any combina-
14 tion of these.
15 (23) "GPS" is the abbreviation for global positioning system which is
16 satellite surveying based on observations of the electromagnetic signals
17 broadcast from the U.S. department of defense's NAVSTAR GPS system.
18 (34) "Idaho coordinate system" shall mean that system of plane coordi-
19 nates as established and designated by chapter 17, title 55, Idaho Code.
20 (45) "Monument" is a physical structure or object that occupies the exact
21 position of a corner.
22 (56) "Property controlling corner" for a property is a public land survey
23 corner, or any property corner, which does not lie on a property line of the
24 property in question, but which controls the location of one (1) or more of
25 the property corners of the property in question.
26 (67) "Property corner" is a geographic point on the surface of the earth,
27 and is on, a part of, and controls a property.
28 (78) "Public land survey corner" is any point actually established and
29 monumented in an original survey or resurvey that determines the boundaries of
30 remaining public lands, or public lands patented, represented on an official
31 plat and in the field notes thereof, accepted and approved under authority
32 delegated by congress to the U.S. general land office and the U.S. department
33 of interior, bureau of land management.
34 (89) "Survey" shall mean the locating and monumenting of points of lines
35 which define the exterior boundary or boundaries common to two (2) or more
36 ownerships, except those boundaries defining ownership in established and on-
37 going mineral extraction operations; or which reestablish or restore public
38 land survey corners in accordance with established principles of land survey-
39 ing by or under the supervision of a surveyor.
40 (910) "Surveyor" shall mean every person authorized by the state of Idaho
41 to practice the profession of land surveying.
42 SECTION 2. That Section 55-1906, Idaho Code, be, and the same is hereby

1 amended to read as follows:
2 55-1906. RECORDS OF SURVEY -- CONTENTS. The records of survey shall show:
3 (1) All monuments found, or set, or reset, or replaced, or removed,
4 describing their kind, size, and location using bearings and distances, and
5 giving other data relating thereto;
6 (2) Evidence of compliance with chapter 16, title 55, Idaho Code, includ-
7 ing instrument numbers of any corner records which have been recorded previ-
8 ously or and corner records of any corners which are set in conjunction with
9 the survey being submitted; basis of bearings, bearing and length of lines,
10 scale of map, and north arrow;
11 (3) Section, or part of section, township and range in which the survey
12 is located and reference to adjoining surveys of record within or crossing or
13 adjoining the survey;
14 (4) Certificate of survey;
15 (5) Ties to at least two (2) public land survey corner monuments of
16 record in one (1) or more of the sections containing the record of survey, or
17 in lieu of public land survey corners, to two (2) corners of records recog-
18 nized by the county surveyor. Records of survey which are within previously
19 platted subdivisions of record need not be tied to public land survey corner
20 monuments.

The purpose of this legislation is to define "basis of bearing" in
the records of survey law; and to clarify that all corner records
should be referenced on a survey; and to clarify that locations
must include a bearing and distance; and to clarify what surveys of
record must be referenced.
FISCAL IMPACT
The passage of this legislation will not impact the general fund of
the state of Idaho or any dedicated funds of any agency of the
state of Idaho or any known private funds.
