  1                                        AN ACT
  2    RELATING TO THE DEPARTMENT OF INSURANCE; AMENDING SECTION 41-210, IDAHO  CODE,
  3        TO  AUTHORIZE  THE  DIRECTOR  TO SPECIFY THE PLACE AND MANNER OF FILING OF
  4        DOCUMENTS.
                                                                        
  5    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  6        SECTION 1.  That Section 41-210, Idaho Code, be, and the  same  is  hereby
  7    amended to read as follows:
                                                                        
  8        41-210.  GENERAL POWERS, DUTIES. (1) The director shall enforce the provi-
  9    sions  of  this  code,  and  shall execute the duties imposed upon him by this
 10    code.
 11        (2)  The director shall have the powers and authority expressly  conferred
 12    upon him by or reasonably implied from the provisions of this code.
 13        (3)  The  director  may  conduct  such  examinations and investigations of
 14    insurance matters, in addition to examinations  and  investigations  expressly
 15    authorized, as he may deem proper to determine whether any person has violated
 16    any  provision  of  this  code  or  to secure information useful in the lawful
 17    administration of any such provision. The cost of such additional examinations
 18    and investigations shall be borne by the state.
 19        (4)  For any document required to  be  filed  with  the  director  or  the
 20    department of insurance under the laws of this state, the director may specify
 21    the  place  and  manner  of filing of the document, including whether an elec-
 22    tronic or paper filing is required or acceptable.
 23        (5)  The director shall have such additional powers and duties as  may  be
 24    provided by other laws of this state.

                     STATEMENT  OF  PURPOSE
                            RS 13509
This bill authorizes the Director of the Department of Insurance to
direct the manner and place of filing for any document required to
be filed with the Department.  This will allow the Director to
designate that certain filings that are made by insurers
electronically with the National Association of Insurance
Commissioners and that are electronically accessible by the
Department of Insurance will satisfy the requirement that the
filings be made with the Department.

There will be no fiscal impact.
