  1                                        AN ACT
  2    RELATING TO CIVIL LIABILITY; AMENDING CHAPTER 9, TITLE 6, IDAHO CODE,  BY  THE
  3        ADDITION  OF  A  NEW SECTION 6-930, IDAHO CODE, TO PROVIDE FOR NO PERSONAL
  4        LIABILITY IN CERTAIN INSTANCES FOR INDIVIDUALS SERVING ON GOVERNING BOARDS
  5        OF GOVERNMENTAL UNITS, BOARDS OR AGENCIES OR OF GOVERNMENTAL CORPORATIONS;
  6        AND DECLARING AN EMERGENCY.
                                                                        
  7    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  8        SECTION 1.  That Chapter 9, Title 6, Idaho  Code,  be,  and  the  same  is
  9    hereby  amended by the addition thereto of a NEW SECTION, to be known and des-
 10    ignated as Section 6-930, Idaho Code, and to read as follows:
                                                                        
 11        6-930.  NO PERSONAL LIABILITY FOR INDIVIDUALS SERVING ON GOVERNING  BOARDS
 12    OF  GOVERNMENTAL  UNITS,  BOARDS  OR AGENCIES OR OF GOVERNMENTAL CORPORATIONS.
 13    Individuals constituting the members or officers of the  governing  boards  of
 14    governmental  units,  boards or agencies or of governmental corporations shall
 15    not be personally liable in his or her private capacity for or on  account  of
 16    any  act  performed  or  contract entered into in an official capacity in good
 17    faith and without intent to defraud, in connection with the administration  or
 18    affairs of said governmental units, boards or agencies or of governmental cor-
 19    porations. Such an individual may be designated a party to a civil action only
 20    as permitted by the Idaho rules of civil procedure.
                                                                        
 21        SECTION  2.  An  emergency  existing  therefor,  which emergency is hereby
 22    declared to exist, this act shall be in full force and effect on and after its
 23    passage and approval.

                       STATEMENT OF PURPOSE

The purpose of this legislation is to ascertain that individuals
constituting the members or officers of governing boards of
governmental units, boards and agencies or of governmental
corporations shall not be personally liable in his or her private
capacity for or account of any act performed or contract entered
into in an official capacity.
