  1                                        AN ACT
  2    RELATING TO COUNTY BOUNDARIES AND COUNTY SEATS; AMENDING SECTION 31-110, IDAHO
  3        CODE, TO ALIGN THE WESTERN BOUNDARY DESCRIPTION OF BOISE COUNTY  WITH  THE
  4        DESCRIPTION OF THAT BOUNDARY AS SHARED WITH ADA COUNTY.
                                                                        
  5    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  6        SECTION  1.  That  Section  31-110, Idaho Code, be, and the same is hereby
  7    amended to read as follows:
                                                                        
  8        31-110.  BOISE COUNTY. Boise county is described as follows: beginning  at
  9    the confluence of Mores creek with the Boise river, at the center of the chan-
 10    nel of Boise river;
 11        Western  boundary.  Thence  north forty-four (44) degrees and thirty-eight
 12    (38) minutes west (R.C., section 23f), to the southeast corner of township six
 13    (6) north, range one (1) east until the said line intersects the north line of
 14    township five (5) north; thence east along the north boundary of township five
 15    (5) north to the northeast corner of township five (5) north,  range  one  (1)
 16    east;  thence north twenty-four (24) miles to the northeast corner of township
 17    nine (9) north, range one (1) east;
 18        Northern boundary. Thence east (1915, ch. 165, section 2,  p.  363)  along
 19    the second (2) standard parallel north, to the center of the North Fork of the
 20    Payette  river;  thence northerly along the river to the intersection with the
 21    line between townships ten (10) and eleven (11)  north;  thence  east  to  the
 22    ridge dividing the waters of the Salmon and Payette rivers (1917, ch. 99, sec-
 23    tion  2, p. 361); thence in an easterly direction along the divide which sepa-
 24    rates the waters of the Payette river and its tributaries from the  waters  of
 25    Salmon river and its tributaries (Special and Local Laws, 120), to the head of
 26    the Middle Fork of Salmon river;
 27        Eastern  boundary.  Thence  southerly along the divide which separates the
 28    water flowing into the South Payette river and Bear  Valley  creek  from  that
 29    flowing  into  the  main Salmon river and Cape Horn creek to the summit of the
 30    Sawtooth  mountains;  thence  southerly  along  the  summit  of  the  Sawtooth
 31    mountains (15 Ter. Ses. 26) to the headwaters  of  the  North  Fork  of  Boise
 32    river;
 33        Southern boundary. Thence down the center of the channel of the North Fork
 34    of Boise river and the main Boise river to the place of beginning (3 Ter. Ses.
 35    214).
 36        County seat--Idaho City.

                       STATEMENT OF PURPOSE
                             RS 13543
This legislation will correct a deficiency in Ada and Boise
Counties that has existed for many years regarding boundaries. 
Both counties have had a written description of a section that
are in conflict with each other.  This will clarify the boundary
area.
                          FISCAL IMPACT
There will be no fiscal impact.
