]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-seventh Legislature Second Regular Session - 2004IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 539 BY STATE AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO BILLS FOR ELECTRIC SERVICES; AMENDING CHAPTER 3, TITLE 61, IDAHO 3 CODE, BY THE ADDITION OF A NEW SECTION 61-337, IDAHO CODE, TO ALLOW FOR 4 INFORMATION REGARDING FISH AND WILDLIFE MITIGATION COSTS TO BE INCLUDED ON 5 BILLS FOR ELECTRIC SERVICE. 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. That Chapter 3, Title 61, Idaho Code, be, and the same is 8 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 9 ignated as Section 61-337, Idaho Code, and to read as follows: 10 61-337. FISH AND WILDLIFE MITIGATION INFORMATION. (1) On and after July 11 1, 2004, each electric utility with one thousand (1,000) customers or more may 12 provide information in its bills to its customers regarding the percentage of 13 the electric utility's costs of supplying electric energy to its customers 14 which is utilized for fish and wildlife mitigation purposes on the electric 15 utility's system. 16 (2) On and after July 1, 2004, each cooperative and municipality furnish- 17 ing electric service, as those terms are defined in section 61-332A, Idaho 18 Code, (excepting a cooperative that serves less than one thousand (1,000) cus- 19 tomers and also serves consumers in other states) may provide information on 20 its bills to its customers of the percentage cost of fish and wildlife mitiga- 21 tion included in the cost of electric energy sold to the cooperative or 22 municipality's customers. 23 (3) Annually, at a time at the discretion of the utility or entity, a 24 statement shall be sent to each consumer of electric energy detailing where 25 fish and wildlife mitigation funds of the utility or entity are remitted.

NO. 539 1 AMENDMENT TO SECTION 1 2 On page 1 of the printed bill, delete lines 23 through 25, and insert: 3 "(3) Annually, at a time at the discretion of the utility or entity, a 4 statement shall be posted on the utility's or entity's website detailing to 5 whom and the amount spent on fish and wildlife mitigation by the utility or 6 entity for the most recent fiscal year.".

REVISED REVISED REVISED REVISED REVISED STATEMENT OF PURPOSE RS 13572C3 The intended purpose of this legislation is to allow that the consumer of electrical power be aware of the cost of fish and wildlife mitigation and that the utility or entity may list the cost as a line item on the monthly bill received by the consumer. A yearly statement would also be provided to the consumer listing the recipients of such mitigation funds. FISCAL IMPACT No impact on the general fund. Contact Name: Rep.
