  1                                        AN ACT
  2    RELATING TO THE PURE SEED LAW; AMENDING SECTION 22-434, IDAHO CODE, TO PROVIDE
  3        AN EXEMPTION FROM LICENSING REQUIREMENTS FOR CERTAIN SEED DEALERS  AND  TO
  4        MAKE TECHNICAL CORRECTIONS.
                                                                        
  5    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  6        SECTION  1.  That  Section  22-434, Idaho Code, be, and the same is hereby
  7    amended to read as follows:
                                                                        
  8        22-434.  SEED DEALER'S LICENSE. An in-state seed dealer or an out-of-state
  9    seed dealer who conditions or labels or sells, for the use of others any seed,
 10    shall obtain a license from the department authorizing  him  to  condition  or
 11    label or sell such seed. A dealer shall not be entitled to a license unless he
 12    has an established plant, warehouse or place of business.
 13        (1)  A  separate license shall be required for each place of business from
 14    which seed regulated under this chapter  is  sold.  Application  for  licenses
 15    shall be on a form provided by the director.
 16        (2)  Applications shall be renewed no later than July 1 of each year.
 17        (3)  Fees  so collected shall be paid into the state treasury and credited
 18    to the state agricultural inspection account.
 19        (4)  In-state producers selling their own crop shall be exempt  from  this
 20    section.
 21        (5)  Any  person  selling  seed  who has total annual gross seed sales not
 22    exceeding five hundred dollars ($500) is exempt from this section.
 23        (6)  An in-state seed dealer or an out-of-state seed  dealer,  who  sells,
 24    offers  for  sale,  exposes for sale or delivers seed only in packages of less
 25    than eight (8) ounces shall be exempt from this section.
 26        (7)  The department may suspend, revoke, or refuse to issue or  renew  the
 27    license of any person when it is satisfied that:
 28        (1a)  The  applicant  or  licensee has been guilty of fraud, deception, or
 29        misrepresentation in the procurement of a license; and/or
 30        (2b)  The licensee was guilty of violating any of the provisions  of  this
 31        chapter.

                       STATEMENT OF PURPOSE
                             RS 13671

Amends the Pure Seed Law to provide an exemption from licensing
requirements for certain seed dealers who sell, offer for sale,
expose for sale or deliver seed only in packages of less than
eight (8) ounces.  Allows for technical corrections to be made to
the existing law.


                         Fiscal Impact
                                
There will be no fiscal impact because these seed dealers do not
currently obtain a seed dealers license.
