  2    RELATING TO FISH AND GAME; AMENDING SECTION  36-407,  IDAHO  CODE,  TO  PERMIT
  3        HOLDERS  OF YOUTH LICENSES TO HUNT TURKEYS; AMENDING SECTION 36-412, IDAHO
  4        CODE, TO AUTHORIZE A REDUCED COST LICENSE  TO  JUNIOR  AGED  GRADUATES  OF
  5        HUNTER  SAFETY COURSES; DECLARING AN EMERGENCY AND PROVIDING A RETROACTIVE
  6        EFFECTIVE DATE.
                                                                        
  7    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  8        SECTION 1.  That Section 36-407, Idaho Code, be, and the  same  is  hereby
  9    amended to read as follows:
                                                                        
 10        36-407.  NONRESIDENT  COMBINATION, FISHING, HUNTING, AND TRAPPING LICENSES
 11    -- FEES -- RIGHTS UNDER. Licenses of the sixth class shall be issued  to  non-
 12    residents in the several kinds and for fees as follows:
 13        (a)  Nonresident Hunting License. A license issued only to a person twelve
 14    (12) years of age or older entitling said person to pursue, hunt, or kill game
 15    birds,  small  game animals, unprotected birds and animals and predatory birds
 16    and animals and to purchase game tags as provided in section 36-409(b),  Idaho
 17    Code.  Provided,  that  a  license  may be issued to qualified persons who are
 18    eleven (11) years of age to allow the application for a controlled  hunt  per-
 19    mit;  however, said persons shall not hunt until they are twelve (12) years of
 20    age.  A license of this kind may be had upon payment of a fee as specified  in
 21    section 36-416, Idaho Code.
 22        (b)  Nonresident  Season  Fishing License. A license entitling a person to
 23    fish in the public waters of the state. A license of this kind may be had upon
 24    payment of a fee as specified in section 36-416, Idaho Code.
 25        (c)  Nonresident Trapping License. A license entitling a  person  to  trap
 26    fur-bearing, unprotected, and predatory animals. A license of this kind may be
 27    had  upon payment of a fee as specified in section 36-416, Idaho Code, provid-
 28    ing the state of residence of said  person  grants  similar  trapping  license
 29    privileges to residents of Idaho.
 30        (d)  Nonresident  Nongame License. A license entitling a person to carry a
 31    shotgun or rifle for the protection of livestock, or to pursue, hunt and  kill
 32    unprotected birds and animals and predatory birds and animals of this state. A
 33    license  of  this  kind  may be had by a nonresident person who is twelve (12)
 34    years of age or older upon payment of a fee as specified  in  section  36-416,
 35    Idaho Code. This license shall be valid only during the period of January 1 to
 36    August  31 of the calendar year in which issued, unless verified by the direc-
 37    tor that the licensee requires such a license to  authorize  him  to  carry  a
 38    shotgun  or  rifle for the protection of livestock, in which case said license
 39    shall be valid until December 31 of the year in which issued.
 40        (e)  Nonresident Two Day Small Game Hunting License. A license issued only
 41    to a person twelve (12) years of age or older, entitling the  person  to  hunt
 42    upland  game birds (to include turkeys), migratory game birds, cottontail rab-
 43    bits, and pygmy rabbits. A person holding  this  license  shall  purchase  the

  1    appropriate  required  tags and permits, and may not hunt pheasants in an area
  2    during the first five (5) days of the pheasant season in that area. A  license
  3    of  this type may be had upon payment of a fee as specified in section 36-416,
  4    Idaho Code.
  5        (f)  Falconry Meet Permit. The director may issue a special permit  for  a
  6    regulated  meet  scheduled for a specific number of days upon payment of a fee
  7    as specified  in section 36-416, Idaho Code. Only trained raptors may be  used
  8    under the special permit issued under the provisions of this subsection.
  9        (g)  Daily Fishing License -- Resident May Purchase. A license entitling a
 10    person  to fish in the waters of the state on a day-to-day basis. A license of
 11    this kind may be had by a resident or nonresident person  (the  provisions  of
 12    section  36-405, Idaho Code, notwithstanding), upon payment of a fee as speci-
 13    fied in section 36-416, Idaho Code, for the first effective day and a  fee  as
 14    specified in section 36-416, Idaho Code, for each consecutive day thereafter.
 15        (h)  Nonresident  Three  Day Fishing License with Steelhead or Salmon Per-
 16    mit. A license entitling a nonresident to fish in the waters of the state  for
 17    a period of three (3) consecutive days for any fish, including steelhead trout
 18    or anadromous salmon during an open season for those fish may be had upon pay-
 19    ment  of  a  fee as specified in section 36-416, Idaho Code. The three (3) day
 20    license holder may fish for any species of fish, steelhead trout  and  anadro-
 21    mous  salmon subject to the limitations prescribed in rules promulgated by the
 22    commission. A nonresident may purchase as many of  the  licenses  provided  in
 23    this  subsection as he desires provided that the nonresident is otherwise eli-
 24    gible to do so.
 25        (i)  Nonresident Junior Fishing License. A license entitling a nonresident
 26    who is less than eighteen (18) years of age to fish  in  the  waters  of  this
 27    state  may  be had upon payment of a fee as specified in section 36-416, Idaho
 28    Code.
 29        (j)  Nonresident Combination Licenses. A license entitling the  person  to
 30    hunt and fish for game animals, game birds, fish and unprotected and predatory
 31    animals  of the state may be had by a person twelve (12) years of age or older
 32    upon payment of a fee as specified in section 36-416, Idaho  Code.  A  license
 33    may  be  issued to a qualified person who is eleven (11) years of age to allow
 34    the application for a controlled hunt permit; however, the  person  shall  not
 35    hunt until he is twelve (12) years of age.
 36        (k)  Nonresident  Junior  Mentored  Hunting License. A license entitling a
 37    nonresident between twelve (12) and seventeen (17) years of age, inclusive, to
 38    hunt game animals, upland  game  birds  (including  turkeys),  migratory  game
 39    birds,  cottontail rabbits, pygmy rabbits, and unprotected and predatory birds
 40    and animals of this state only when accompanied in the field by the holder  of
 41    an  adult  Idaho hunting license. A person holding this license shall purchase
 42    the appropriate required tags as provided in section  36-409(b),  Idaho  Code,
 43    and  permits.  Provided, that a license may be issued to qualified persons who
 44    are eleven (11) years of age to allow the application for  a  controlled  hunt
 45    permit;  however, said persons shall not hunt until they are twelve (12) years
 46    of age. A license of this kind may be had upon payment of a fee  as  specified
 47    in section 36-416, Idaho Code.
 48        (l)  Nonresident Youth Small Game Licenses -- Hunting. A license entitling
 49    a  nonresident  of  ten  (10)  or eleven (11) years of age to hunt upland game
 50    birds (including turkeys), migratory game  birds,  cottontail  rabbits,  pygmy
 51    rabbits,  and  unprotected  and predatory birds and animals of this state only
 52    while accompanied in the field by the holder of an adult Idaho hunting license
 53    may be had upon payment of a fee as specified in section 36-416, Idaho Code.
 54        (m)  Youth Hunter Education Graduate Licenses -- Hunting --  Resident  May
 55    Purchase.  A  license  entitling  a person between ten (10) and seventeen (17)

  1    years of age, inclusive, to hunt upland game birds (except including turkeys),
  2    migratory game birds, cottontail rabbits, pygmy rabbits, and  unprotected  and
  3    predatory  birds  and animals of this state only when accompanied in the field
  4    by the holder of an adult Idaho hunting license. A person holding this license
  5    shall purchase the appropriate required permits. A license of this kind may be
  6    issued  to a resident or nonresident person, notwithstanding the provisions of
  7    section 36-405, Idaho Code, upon payment of a  fee  as  specified  in  section
  8    36-416, Idaho Code.
                                                                        
  9        SECTION  2.  That  Section  36-412, Idaho Code, be, and the same is hereby
 10    amended to read as follows:
                                                                        
 11        36-412.  EDUCATION PROGRAMS -- INSTRUCTOR QUALIFICATIONS -- FEE.  (a)  The
 12    fish  and game commission shall prescribe and administer education programs in
 13    hunting and archery. Such programs  shall  provide  instruction  in  the  safe
 14    handling of lawful hunting equipment. The programs shall also include instruc-
 15    tion  on  wildlife and natural resource conservation, good conduct and respect
 16    for the rights and property of others, and survival in the outdoors. The  com-
 17    mission may enter into agreements with public or private agencies and individ-
 18    uals in carrying out the provisions of this subsection.
 19        (b)  The  department  of  fish  and game shall recruit competent volunteer
 20    instructors. The department shall provide training for the instructors in  the
 21    safe handling of legal hunting equipment, conservation of wildlife and natural
 22    resources,  good  conduct  and  respect for the rights and property of others,
 23    outdoor survival, and other appropriate  subjects  for  training  instructors.
 24    Instructors  shall be issued certificates and shall on a voluntary basis, give
 25    instruction in education programs as established by the department of fish and
 26    game, to all eligible applicants.
 27        (c)  The commission shall establish fees for each program  not  to  exceed
 28    eight  dollars  ($8.00) for persons who are age seventeen (17) years and under
 29    and not to exceed eight dollars ($8.00) for persons age  eighteen  (18)  years
 30    and older, to be assessed each individual obtaining instruction in hunter edu-
 31    cation  for  reimbursement  for furnished materials. All students successfully
 32    completing the course of instruction shall be issued a certificate of  comple-
 33    tion  in hunter safety and good hunting conduct. The department may also issue
 34    a youth hunter education graduate hunting  license  to  students  successfully
 35    completing  the  course  or  allow  the  students  successfully completing the
 36    course, who are otherwise qualified to purchase a junior hunting  license,  to
 37    purchase  a  junior  hunting  the  license  at a reduced fee pursuant to rules
 38    adopted by the commission.
                                                                        
 39        SECTION 3.  An emergency existing  therefor,  which  emergency  is  hereby
 40    declared to exist, this act shall be in full force and effect on and after its
 41    passage and approval, and retroactively to January 1, 2004.

Statement of Purpose / Fiscal Impact



                       STATEMENT OF PURPOSE
                             RS 13780
This legislation would amend Section 36-404, Idaho Code, to make
it clear that a youth hunter granted a hunting license would be
accompanied by an adult with an Idaho Hunting License and be
close enough to the youth in the field to adequately control as
well as teach the youth while hunting.
                          FISCAL IMPACT

There will be no fiscal impact on the General Fund.
