HOUSE BILL NO. 595
1 AN ACT
2 RELATING TO RULES OF THE DIVISION OF HUMAN RESOURCES; AMENDING CHAPTER 53,
3 TITLE 67, IDAHO CODE, BY THE ADDITION OF A NEW SECTION 67-5309D, IDAHO
4 CODE, TO CREATE THE HUMAN RESOURCES REVIEW COMMITTEE, TO SET FORTH THE
5 COMPOSITION OF THE COMMITTEE, TO PROVIDE FOR MEETINGS AND TO REQUIRE THE
6 SUBMISSION OF A REPORT TO THE LEGISLATURE; DECLARING AN EMERGENCY AND PRO-
7 VIDING A SUNSET DATE.
8 Be It Enacted by the Legislature of the State of Idaho:
9 SECTION 1. That Chapter 53, Title 67, Idaho Code, be, and the same is
10 hereby amended by the addition thereto of a NEW SECTION, to be known and des-
11 ignated as Section 67-5309D, Idaho Code, and to read as follows:
12 67-5309D. HUMAN RESOURCES REVIEW COMMITTEE. (1) There is hereby created
13 the human resources review committee to review all rules of the division of
14 human resources for purposes of evaluating the rules and recommending changes
15 to the rules that would ensure an equitable system.
16 (2) The committee shall be composed of:
17 (a) The chairs of the senate and house of representatives commerce and
18 human resources committees, who shall serve as co-chairs of the committee;
19 (b) Two (2) representatives of the division of human resources;
20 (c) Two (2) representatives of the Idaho public employees association;
22 (d) Two (2) representatives of the service employees international union.
23 (3) The committee shall meet at the call of, and at a place designated
24 by, the co-chairs and shall submit a report to the legislature by February 1,
25 2005, regarding the rules and any recommendations for rule changes.
26 SECTION 2. An emergency existing therefor, which emergency is hereby
27 declared to exist, this act shall be in full force and effect on and after its
28 passage and approval; and shall be null, void and of no force and effect on
29 and after February 1, 2005.
STATEMENT OF PURPOSE
The purpose of this legislation is to call for a special
committee to review the proposed rules set forth by the Division
of Human Resources and Idaho Personnel Commission, docket 15-
1401-1301. The sections contain numerous and complex items
affecting employers and employees which deserve further scrutiny
and consensus building. The legislation calls for the formation
of the committee, sets forth the composition, and provides a
