  1                                        AN ACT
  2    RELATING TO RECALL ELECTIONS IN SCHOOL  DISTRICTS;  AMENDING  SECTION  33-432,
  3        IDAHO  CODE,  TO  REQUIRE A RECALL PETITION FOR A TRUSTEE OF A SCHOOL DIS-
  4        TRICT TO BE CANVASSED NOT MORE THAN TEN DAYS FROM THE DATE OF ITS  FILING;
  5        AND DECLARING AN EMERGENCY.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION  1.  That  Section  33-432, Idaho Code, be, and the same is hereby
  8    amended to read as follows:
                                                                        
  9        33-432.  CANVASSING PETITION FOR SUFFICIENCY OF SIGNATURES -- NOTICE. Upon
 10    the filing of a recall petition in his office, the clerk of the  school  board
 11    with  whom  the charge was filed shall stamp on each petition the date of fil-
 12    ing, and shall notify the person filing them  and  the  school  trustee  whose
 13    recall  is  demanded  of  the date when the petitions will be canvassed, which
 14    date shall be not less than five (5) nor more than ten (10) days from the date
 15    of its filing.
                                                                        
 16        SECTION 2.  An emergency existing  therefor,  which  emergency  is  hereby
 17    declared to exist, this act shall be in full force and effect on and after its
 18    passage and approval.

                      STATEMENT OF PURPOSE

                            RS 13445

The purpose of this legislation is to require a recall petition for a
trustee of a school district to be canvassed between the first day
received and not more than ten days from the date of its filing.

No fiscal impact to the general fund.
