]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-seventh Legislature Second Regular Session - 2004IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 598 BY STATE AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO PUBLIC WORKS; AMENDING SECTION 44-1001, IDAHO CODE, TO REQUIRE 3 CONTRACTORS, OR PERSONS IN CHARGE OF A CONTRACT, TO FILE CERTAIN REPORTS 4 WITH THE CONTRACTING AUTHORITY. 5 Be It Enacted by the Legislature of the State of Idaho: 6 SECTION 1. That Section 44-1001, Idaho Code, be, and the same is hereby 7 amended to read as follows: 8 44-1001. EMPLOYMENT OF RESIDENTS OF IDAHO -- WAGE SCALE -- FEDERAL FUNDS. 9 In all state, county, municipal, and school construction, repair, and mainte- 10 nance work under any of the laws of this state the contractor, or person in 11 charge thereof must employ ninety-five percent (95%) bona fide Idaho residents 12 as employees on any such contracts except where under such contracts fifty 13 (50) or less persons are employed the contractor may employ ten percent (10%) 14 nonresidents, provided however, in all cases such employers must give prefer- 15 ence to the employment of bona fide Idaho residents in the performance of such 16 work; provided, that in work involving the expenditure of federal aid funds 17 this act shall not be enforced in such a manner as to conflict with or be con- 18 trary to the federal statutes prescribing a labor preference to honorably dis- 19 charged soldiers, sailors, and marines, prohibiting as unlawful any other 20 preference or discrimination among the citizens of the United States. Upon 21 completion of a contract, as well as with any progress report that is required 22 by the contracting authority prior to completion of a contract, the contrac- 23 tor, or person in charge of a contract, shall provide the contracting author- 24 ity with a certified report verifying compliance with the provisions of this 25 section, which report shall include the total number of employees on the con- 26 tract and the number of those employees that are bona fide Idaho residents.
STATEMENT OF PURPOSE RS 13755 This legislation adds a reporting requirement to Section 44-1001 of Idaho Code, so that contracting authorities may readily verify compliance with the 95% residency requirements in hiring for all state, county, municipal, and school district construction contracts.
