]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-seventh Legislature Second Regular Session - 2004IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 603 BY EDUCATION COMMITTEE 1 AN ACT 2 RELATING TO CONTRACTS FOR SCHOOL TRANSPORTATION; AMENDING SECTION 33-1510, 3 IDAHO CODE, TO AUTHORIZE RENEWAL OF AN EXISTING CONTRACT UNDER CONDITIONS 4 SPECIFIED AND TO PROVIDE FOR LENGTH OF THE RENEWAL; AND DECLARING AN EMER- 5 GENCY. 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. That Section 33-1510, Idaho Code, be, and the same is hereby 8 amended to read as follows: 9 33-1510. CONTRACTS FOR TRANSPORTATION SERVICE. All contracts entered into 10 by boards of trustees for the transportation of pupils shall be in writing in 11 a form approved by the state superintendent of public instruction. No contract 12 shall be executed covering a period of time exceeding five (5) years. School 13 districts shall advertise, bid and contract for all bus transportation service 14 routes at a single time, and contract with the lowest responsible bidder or 15 bidders meeting the specifications; provided that, one (1) time only, a school 16 district may renew a contract with the current contractor if the board of 17 trustees, after renegotiation with the contractor, determines that the terms 18 are satisfactory to the district. The board of trustees may renew the contract 19 for a term not to exceed five (5) years. 20 Before entering into such contracts, the board of trustees shall invite 21 bids by twice giving notice as provided in section 33-402 g., Idaho Code, and 22 shall award the contract to the lowest responsible bidder. 23 SECTION 2. An emergency existing therefor, which emergency is hereby 24 declared to exist, this act shall be in full force and effect on and after its 25 passage and approval.

NO. 603 1 AMENDMENT TO SECTION 1 2 On page 1 of the printed bill, in line 19, following "years" insert: ". 3 Renewal of any contract pursuant to this section shall not be granted unless 4 the provisions of this section were included, in a substantially conforming 5 summary, within the bidding notice, published pursuant to section 33-601, 6 Idaho Code, of the contract". 7 CORRECTIONS TO TITLE 8 On page 1, in line 4, delete "SPECIFIED AND" and insert: "SPECIFIED,"; and 9 also in line 4, following "RENEWAL" insert: "AND TO REQUIRE THAT CERTAIN PRO- 10 VISIONS BE INCLUDED IN THE BIDDING NOTICE".

STATEMENT OF PURPOSE RS 13563 The purpose of this legislation is to allow school districts who contract school bus transportation services the opportunity, on a one-time basis, to renew the transportation contract with the current contractor. If the school district finds, after renegotiation, that the terms are satisfactory the school district would be allowed to renew the contract for up to five (5) years. This legislation would provide the current contractor the opportunity to potentially extend the contract tenure and help assist in capital purchase amortization. FISCAL IMPACT There is no known impact on the General Fund, but it would be hoped that it would reduce contract costs and lower overall state transportation costs. Contact Name: Rep.
