]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-seventh Legislature Second Regular Session - 2004IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 604 BY TRANSPORTATION AND DEFENSE COMMITTEE 1 AN ACT 2 RELATING TO OPTICAL STROBE LIGHT DEVICES; AMENDING CHAPTER 8, TITLE 49, IDAHO 3 CODE, BY THE ADDITION OF A NEW SECTION 49-811, IDAHO CODE, TO DEFINE THE 4 TERM "OPTICAL STROBE LIGHT DEVICE," TO LIMIT THE USE OF AN OPTICAL STROBE 5 LIGHT DEVICE TO CERTAIN VEHICLES AND TO PROVIDE MISDEMEANOR PENALTIES FOR 6 VIOLATION. 7 Be It Enacted by the Legislature of the State of Idaho: 8 SECTION 1. That Chapter 8, Title 49, Idaho Code, be, and the same is 9 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 10 ignated as Section 49-811, Idaho Code, and to read as follows: 11 49-811. USE OF OPTICAL STROBE LIGHT DEVICES. (1) As used in this section 12 "optical strobe light device" shall mean a strobe light device which emits an 13 optical signal at a specific frequency to a traffic control light enabling 14 police or emergency vehicles to obtain the right-of-way at intersections or 15 enabling transportation department, city, county or highway district mainte- 16 nance vehicles to perform maintenance tests on traffic control lights. 17 (2) A person shall be guilty of a misdemeanor if the person uses an opti- 18 cal strobe light device while operating or riding in a motor vehicle or other 19 vehicle on the highways of this state unless the motor vehicle is a police or 20 authorized emergency vehicle, as defined in section 49-123(2)(b), Idaho Code, 21 or is a transportation department, city, county or highway district mainte- 22 nance vehicle and the person is on official emergency duty while operating or 23 riding in the vehicle. 24 (3) A person found guilty of violating subsection (2) of this section 25 shall be sentenced by imprisonment of not greater than six (6) months, by a 26 fine not in excess of one thousand dollars ($1,000), or by both such fine and 27 imprisonment.

(1) As used in this section 12 "optical strobe light device" shall mean a strobe light device which emits an 13 optical signal at a specific frequency to a traffic control signal enabling 14 police or emergency vehicles to obtain the right-of-way at intersections or 15 enabling transportation department, city, county or highway district mainte- 16 nance vehicles to perform maintenance tests on traffic control signals. 17 (2) A person shall be guilty of a misdemeanor if the person uses an opti- 18 cal strobe light device on the highways of this state unless the person is 19 operating or riding in an authorized emergency vehicle, as defined in section 20 49-123(2)(b), Idaho Code, or is operating or riding in a transportation 21 department, city, county or highway district maintenance vehicle and the per- 22 son is on official emergency duty while operating or riding in the vehicle. 23 (3) A person found guilty of violating subsection (2) of this section 24 shall be sentenced by imprisonment of not greater than six (6) months, by a 25 fine not in excess of one thousand dollars ($1,000), or by both such fine and 26 imprisonment.
STATEMENT OF PURPOSE RS 13692C2 The purpose of this legislation is to prevent the unauthorized use of electronic devices to override traffic signal controls and to prescribe penalties.
