  1                                        AN ACT
  2    RELATING TO SLOW MOVING VEHICLES; AMENDING  SECTION  49-619,  IDAHO  CODE,  TO
  3        CLARIFY  OPERATION  OF SLOW MOVING VEHICLES ON PUBLIC HIGHWAYS AND TO MAKE
  4        TECHNICAL CORRECTIONS.
                                                                        
  5    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  6        SECTION 1.  That Section 49-619, Idaho Code, be, and the  same  is  hereby
  7    amended to read as follows:
                                                                        
  8        49-619.  SLOW MOVING VEHICLES -- RESTRICTIONS AND EXCEPTIONS, EQUIPMENT --
  9    EMBLEMS  ON  CERTAIN  MACHINERY -- LIMITED EXEMPTION. (1) Except for emergency
 10    and snow removal vehicles owned and operated by the  state  or  its  political
 11    subdivisions when enroute to, from, or in the performance of activities essen-
 12    tial  to  the public safety, and implements of husbandry, except on interstate
 13    highways, equipped with lights as required by section 49-916, Idaho Code, when
 14    being moved from one (1) farm operation to another,  and  implements  of  hus-
 15    bandry  when operating from one-half hour after sunset to one-half hour before
 16    sunrise shall have flashing lamps visible from a distance  of  not  less  than
 17    five  hundred  (500) feet to the rear, iIt shall be unlawful to operate a slow
 18    moving vehicle on the highways at the following times and under the  following
 19    circumstances:
 20        (a)  From  a  one-half  (1/2)  hour  after sunset to a one-half (1/2) hour
 21        before sunrise, unless the vehicle or equipment is equipped with lights as
 22        required by section 49-916, Idaho Code;
 23        (b)  At a speed in excess of twenty-five (25) miles per hour,  unless  the
 24        vehicle or equipment, including towed units of farm equipment, is designed
 25        to  safely  travel at speeds in excess of twenty-five (25) miles per hour,
 26        but no such vehicle or equipment shall exceed  the  posted  maximum  speed
 27        limit and shall be operated by a licensed driver;
 28        (c)  In  such  a manner as to obstruct the free movement of traffic on the
 29        highways.
 30        (2)  A slow moving vehicle shall be equipped with  a  foot  brake  braking
 31    system  and with a mechanical signaling device as required for other similarly
 32    constructed vehicles.
 33        (3)  All slow moving vehicles, farm tractors, road rollers and  implements
 34    of husbandry shall have affixed at the rear of the vehicle an emblem identify-
 35    ing  them  as slow moving equipment. The Idaho traffic safety commission shall
 36    recommend to the board the minimum standards for the emblem.
 37        (4)  Emergency and snow removal vehicles owned and operated by  the  state
 38    or its political subdivisions when en route to, from, or in the performance of
 39    activities essential to the public safety, shall be exempt from the provisions
 40    of paragraphs (a) and (c) of subsection (1) of this section.

This legislation will clarify Idaho Code 49-619.  This
legislation will allow newer, more modern agriculture equipment
to travel at speeds faster than 25 mph, if they are so designed. 
However in no case shall these vehicles be allowed to exceed the
maximum posted speed limit and shall be a licensed driver.
