  1                                        AN ACT
  2    RELATING TO WELFARE; AMENDING SECTION 56-202, IDAHO CODE, TO STRIKE  A  SUNSET
  3        CLAUSE  TO  MAINTAIN  AUTHORIZATION  TO  THE DIRECTOR OF THE DEPARTMENT OF
  4        HEALTH AND WELFARE TO PROVIDE WELFARE ASSISTANCE TO DRUG DEPENDENT PERSONS
  5        UPON CERTAIN CIRCUMSTANCES.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION 1.  That Section 56-202, Idaho Code, be, and the  same  is  hereby
  8    amended to read as follows:
                                                                        
  9        56-202.  DUTIES OF DIRECTOR OF STATE DEPARTMENT OF HEALTH AND WELFARE. The
 10    director of the state department of health and welfare shall:
 11        (a)  Administer public assistance and social services to eligible people;
 12        (b)  Promulgate, adopt and enforce such rules and such methods of adminis-
 13    tration as may be necessary or proper to carry out the provisions of title 56,
 14    Idaho Code, except as provided in section 56-203A, Idaho Code;
 15        (c)  Conduct research and compile statistics relating to public welfare;
 16        (d)  Prepare  for the governor and legislature an annual report of activi-
 17    ties and expenditures; make such reports in  such  form  and  containing  such
 18    information  as the federal government may from time to time require; and com-
 19    ply with such provisions as the federal government may from time to time  find
 20    necessary to assure the correctness and verification of such reports;
 21        (e)  Cooperate  with the federal government through its appropriate agency
 22    or instrumentality in establishing, extending, and strengthening services  for
 23    the  protection  and  care of homeless, dependent, and neglected children, and
 24    children in danger of becoming delinquent; and to undertake other services for
 25    children authorized by law;
 26        (f)  Cooperate with the federal government through its appropriate  agency
 27    or  instrumentality  in establishing and maintaining a comprehensive system of
 28    in-home services as defined in section 67-5006, Idaho Code, designed to assist
 29    older persons, as defined in section 67-5006, Idaho Code, of Idaho to continue
 30    living in an independent and dignified home environment and to undertake other
 31    services for older persons as authorized by law;
 32        (g)  Exercise the opt out provision in section 115 of the personal respon-
 33    sibility and work opportunity reconciliation act of 1996, P. L. 104-193.  Con-
 34    sistent  with this, the department may provide food stamps and services funded
 35    under title 4A (including cash assistance, TANF  supportive  services  and  at
 36    risk payments) to a person who has been convicted of a felony involving a con-
 37    trolled substance as defined in chapter 27, title 37, Idaho Code, if they com-
 38    ply with the terms of a withheld judgment, probation or parole. The provisions
 39    of  this  subsection (g) shall be null, void and of no force and effect on and
 40    after June 30, 2003.

                       STATEMENT OF PURPOSE
                            RS 13647

*The purpose of this legislation is to reinstate a program which
was scheduled to sunset June 30, 2003.  The legislation makes it
possible to provide Food Stamps and Temporary Cash Assistance and
supportive services to persons convicted of a drug related
felony, provided they are in compliance with probation and
parole.

                          FISCAL IMPACT

*Federal funds pay for 100% of Food Stamps benefits, TAFI Cash
Assistance, TAFI supportive services and 50% of Food Stamp
Supportive Services.  Idaho's match for this program would be
approximately $135 in a twelve month period.  The Department of
Health and Welfare reports that approximately ninety households
are served in the program and projects that this number will
remain constant.
