]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-seventh Legislature Second Regular Session - 2004IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 630 BY STATE AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO SALARIES OF MEMBERS OF THE PUBLIC UTILITIES COMMISSION, THE STATE 3 TAX COMMISSION AND THE INDUSTRIAL COMMISSION; AMENDING SECTION 61-215, 4 IDAHO CODE, TO PROVIDE THAT ON JULY 1, 2004, AND EACH JULY 1 THEREAFTER, 5 THE ANNUAL SALARY OF EACH COMMISSIONER SHALL BE INCREASED BY THE CHANGE IN 6 EMPLOYEE COMPENSATION ADOPTED BY THE LEGISLATURE FOR CLASSIFIED STATE 7 EMPLOYEES, UNLESS THE LEGISLATURE SHALL REJECT SUCH INCREASE IN SALARY BY 8 ADOPTION OF A CONCURRENT RESOLUTION; AMENDING SECTION 63-102, IDAHO CODE, 9 TO PROVIDE THAT ON JULY 1, 2004, AND EACH JULY 1 THEREAFTER, THE ANNUAL 10 SALARY OF EACH COMMISSIONER SHALL BE INCREASED BY THE CHANGE IN EMPLOYEE 11 COMPENSATION ADOPTED BY THE LEGISLATURE FOR CLASSIFIED STATE EMPLOYEES, 12 UNLESS THE LEGISLATURE SHALL REJECT SUCH INCREASE IN SALARY BY ADOPTION OF 13 A CONCURRENT RESOLUTION; AND AMENDING SECTION 72-503, IDAHO CODE, TO PRO- 14 VIDE THAT ON JULY 1, 2004, AND EACH JULY 1 THEREAFTER, THE ANNUAL SALARY 15 OF EACH COMMISSIONER SHALL BE INCREASED BY THE CHANGE IN EMPLOYEE COMPEN- 16 SATION ADOPTED BY THE LEGISLATURE FOR CLASSIFIED STATE EMPLOYEES, UNLESS 17 THE LEGISLATURE SHALL REJECT SUCH INCREASE IN SALARY BY ADOPTION OF A CON- 18 CURRENT RESOLUTION. 19 Be It Enacted by the Legislature of the State of Idaho: 20 SECTION 1. That Section 61-215, Idaho Code, be, and the same is hereby 21 amended to read as follows: 22 61-215. SALARIES OF PUBLIC UTILITIES COMMISSIONERS. Each member of the 23 public utilities commission shall devote full time to the performance of 24 his/her duties. Commencing on July 1, 2000, the annual salary of members of 25 the public utilities commission shall be seventy-seven thousand six hundred 26 twenty-five dollars ($77,625), which amount shall be increased on July 1, 27 2001, by four and one-half percent (4 1/2%), and shall be paid from sources 28 set by the legislature. On July 1, 2004, and each July 1 thereafter, the 29 annual salary of each commissioner shall be increased by the change in 30 employee compensation adopted by the legislature for classified state employ- 31 ees, unless the legislature shall reject such increase in salary by adoption 32 of a concurrent resolution. 33 SECTION 2. That Section 63-102, Idaho Code, be, and the same is hereby 34 amended to read as follows: 35 63-102. ORGANIZATION -- CHAIRMAN -- COMPENSATION -- QUORUM -- HEARINGS. 36 (1) A member of the state tax commission shall be appointed by the governor, 37 to serve at his pleasure, as chairman. Each member of the state tax commission 38 shall devote full time to the performance of duties. Commencing on July 1, 39 2001, the annual salary for members of the state tax commission shall be sev- 40 enty thousand three hundred two dollars ($70,302). On July 1, 2004, and each 41 July 1 thereafter, the annual salary of each commissioner shall be increased 2 1 by the change in employee compensation adopted by the legislature for classi- 2 fied state employees, unless the legislature shall reject such increase in 3 salary by adoption of a concurrent resolution. 4 (2) A majority of the state tax commission shall constitute a quorum for 5 the transaction of business. The state tax commission may delegate to any mem- 6 ber of the commission or to its employees, the power to make investigations 7 and hold hearings at any place it may deem proper, and such other matters as 8 will facilitate the operations of the commission. 9 (3) The chairman of the state tax commission shall delegate to each com- 10 missioner the responsibility for policy management and oversight of one (1) or 11 more of the taxes collected and/or activities supervised or administered by 12 the commission. The state tax commission shall perform the duties imposed upon 13 it by law and shall adopt all rules by majority decision. 14 In any case in which the state tax commission sits as an appellate body 15 upon an appeal from a tax decision from one (1) of the various administrative 16 units subject to its supervision, the state tax commissioner charged with 17 responsibility for policy management and oversight of the tax in controversy 18 shall not vote upon the appeal but may advise the remaining members of the 19 commission on the technical aspects of the problems before them. 20 (4) The chairman shall be the chief executive officer and administrative 21 head of the state tax commission and shall be responsible for, or may assign 22 responsibility for, all personnel, budgetary and/or fiscal matters of the 23 state tax commission. 24 SECTION 3. That Section 72-503, Idaho Code, be, and the same is hereby 25 amended to read as follows: 26 72-503. SALARY. Commencing July 1, 2000, the annual salary of each member 27 of the industrial commission shall be seventy-five thousand five hundred fif- 28 ty-five dollars ($75,555), which amount shall be increased on July 1, 2001, by 29 four and one-half percent (4 1/2%). Industrial commissioner salaries shall be 30 paid from sources set by the legislature. Each member of the industrial com- 31 mission shall devote full time to the performance of his duties. On July 1, 32 2004, and each July 1 thereafter, the annual salary of each commissioner shall 33 be increased by the change in employee compensation adopted by the legislature 34 for classified state employees, unless the legislature shall reject such 35 increase in salary by adoption of a concurrent resolution.

STATEMENT OF PURPOSE RS 13877 This legislation that provides that on July 1, 2004 and each year thereafter, the annual salary of each Public Utilities Commissioner, Industrial Commissioner and State Tax Commissioner shall be increased by the change in employee compensation adopted by the Legislature for classified state employees, unless the Legislature rejects such increase by adoption of a concurrent resolution. FISCAL IMPACT The annual salaries for Public Utilities Commissioners and Industrial Commissioners are paid from dedicated funds. The only fiscal impact to the general fund would be a future increase in the salaries of the State Tax Commissioners. Contact Name: Rep.
