PERSONNEL SYSTEM - Amends existing law to provide for a benefit survey to
be conducted annually for the purpose specified in law; to provide duties
of the administrator of the Division of Human Resources for conducting or
approving such surveys and submitting reports of the results of salary and
benefit surveys to the Governor by December first of each year; to provide
that the Governor shall submit his recommendations to the Legislature; to
provide for a legislative response to the Governor's recommendations; and
to provide that the administrator shall also use pay schedules when

  1                                        AN ACT
  2    RELATING TO  SALARIES  AND  BENEFITS  OF  STATE  EMPLOYEES;  AMENDING  SECTION
  3        67-5309A,  IDAHO CODE, TO PROVIDE THAT IT IS THE INTENT OF THE LEGISLATURE
  4        THAT A BENEFIT SURVEY SHALL BE CONDUCTED ANNUALLY FOR THE  PURPOSE  SPECI-
  5        FIED;  AND  AMENDING  SECTION  67-5309B,  IDAHO  CODE, TO PROVIDE THAT THE
  6        ADMINISTRATOR SHALL CONDUCT OR APPROVE BENEFIT SURVEYS,  TO  PROVIDE  THAT
  7        THE  ADMINISTRATOR SHALL SUBMIT REPORTS OF THE RESULTS OF SALARY AND BENE-
  8        FIT SURVEYS TO THE GOVERNOR BY DECEMBER FIRST OF  EACH  YEAR,  TO  PROVIDE
  9        THAT  THE GOVERNOR SHALL SUBMIT HIS RECOMMENDATIONS TO THE LEGISLATURE, TO
 10        PROVIDE FOR A LEGISLATIVE RESPONSE TO THE GOVERNOR'S RECOMMENDATIONS,  AND
 11        TO PROVIDE THAT THE ADMINISTRATOR SHALL ALSO USE PAY SCHEDULES WHEN IMPLE-
 12        MENTING THE RESULTS OF SALARY CHANGES BY RULE.
                                                                        
 13    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 14        SECTION  1.  That Section 67-5309A, Idaho Code, be, and the same is hereby
 15    amended to read as follows:
                                                                        
 16        67-5309A.  PERSONNEL BENEFITS. It is hereby declared to be the  policy  of
 17    the  legislature  of  the state of Idaho that all classified employees of like
 18    classification and pay grade allocation shall be treated equally  with  refer-
 19    ence to personnel benefits. It is the intent of the legislature that from time
 20    to  time  it  shall authorize a benefit survey shall be conducted annually for
 21    the purpose of determining the relative level of personnel  benefits  provided
 22    to  state employees by comparing the benefits provided to state employees with
 23    the benefits provided to employees of private employers within  the  state  of
 24    Idaho.
                                                                        
 25        SECTION  2.  That Section 67-5309B, Idaho Code, be, and the same is hereby
 26    amended to read as follows:
                                                                        
 27        67-5309B.  ESTABLISHING SALARIES. (a) The administrator of the division of
 28    human resources shall determine the relative worth of each job  classification
 29    established  pursuant  to  section  67-5309,  Idaho  Code, and, in making such
 30    determination, shall utilize the guide chart  profile  method  and  correlated
 31    factoring  benchmark  job  classifications developed by Hay management consul-
 32    tants, to ensure internal equity within the classified service.
 33        (b)  Job classifications established or revised by the administrator shall
 34    be assigned by the administrator to a pay grade subject to the approval of the
 35    administrator of the division of financial management, based on  funding  con-
 36    siderations.
 37        (c)  The administrator shall conduct or approve salary and benefit surveys
 38    within  relevant  labor markets to determine salary ranges that represent com-
 39    petitive labor market average rates paid by private industry and other govern-
 40    mental units for jobs of like value, based upon the guide chart profile system
 41    described in subsection (a) of this section. The results of such surveys shall

  1    be based on statistical, historical, or other economic  factors.  The  factors
  2    herein  referred  to shall include, but are not limited to, anticipated salary
  3    adjustments for the positions surveyed, changes in cost-of-living as  measured
  4    by the consumer price index, and anticipated adjustments in the average weekly
  5    wage  in  the  state  of  Idaho, as defined and determined pursuant to section
  6    72-409, Idaho Code.
  7        (d)  A report of the results of salary and benefit surveys and recommenda-
  8    tions for changes in salaries, together with their estimated costs  of  imple-
  9    mentation  based  on  the  competitive  labor  market average rate of each pay
 10    grade, as approved by the administrator, shall be submitted  to  the  governor
 11    not later than the first day of October December of each year. If the governor
 12    accepts  the  administrator's  report,  he  shall submit it to the legislature
 13    prior to the seventh legislative day of each session. If the governor does not
 14    accept the report of the administrator, he The governor shall submit  his  own
 15    report   recommendations   on   proposed   changes   in   salaries,   and  the
 16    administrator's report, benefits to the legislature prior to the seventh  leg-
 17    islative  day  of each session. The legislature may, by concurrent resolution,
 18    accept, modify or reject either report the recommendations. The failure of the
 19    legislature to accept, modify or  reject  either  report  the  recommendations
 20    prior  to  adjournment  sine  die  shall constitute approval of the governor's
 21    report recommendations. The administrator shall implement the results of  such
 22    salary  changes by rule, using the payline formulas and pay schedules approved
 23    by the legislature and the mid-point of each pay grade established in  section
 24    67-5309C, Idaho Code.

     This legislation will provide for an annual benefit survey
in conjunction with the annual salary survey and provides for a
later date to have the report of the results submitted to the
governor.
