]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-seventh Legislature Second Regular Session - 2004IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 640 BY JUDICIARY, RULES AND ADMINISTRATION COMMITTEE 1 AN ACT 2 RELATING TO MEDICAL EXAMINATIONS; AMENDING CHAPTER 43, TITLE 39, IDAHO CODE, 3 BY THE ADDITION OF A NEW SECTION 39-4307, IDAHO CODE, TO SET FORTH PATIENT 4 RIGHTS RELATED TO MEDICAL EXAMINATIONS. 5 Be It Enacted by the Legislature of the State of Idaho: 6 SECTION 1. That Chapter 43, Title 39, Idaho Code, be, and the same is 7 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 8 ignated as Section 39-4307, Idaho Code, and to read as follows: 9 39-4307. PATIENT RIGHTS DURING MEDICAL EXAMINATION. Whenever a person is 10 required to undergo a medical examination by contract, in litigation or other- 11 wise, such examination shall be independent, impartial and unbiased. Absent 12 leave of court, the examination shall be performed by a duly qualified, unbi- 13 ased and objective physician or surgeon in good standing who is licensed in 14 Idaho and shall be performed by the provider in the best interests of the 15 patient in accordance with the local standard of care for providers of the 16 same expertise. The examination shall be performed and reported upon in an 17 objective and unbiased manner. The party being examined shall have a right to 18 a copy of any examination report.
