who willfully threatens to commit a violent act on school grounds by use of
a firearm, explosive or deadly or dangerous weapon is guilty of a

  1                                        AN ACT
  2    RELATING TO THREATS OF VIOLENCE; AMENDING CHAPTER 33, TITLE 18, IDAHO CODE, BY
  3        THE ADDITION OF A NEW SECTION 18-3302H, IDAHO CODE, TO  PROVIDE  THAT  ANY
  4        PERSON  WHO  WILLFULLY  THREATENS  TO  COMMIT AN ACT OF VIOLENCE ON SCHOOL
  5        GROUNDS BY USE OF A FIREARM, EXPLOSIVE, OR DEADLY OR DANGEROUS  WEAPON  IS
  6        GUILTY OF A MISDEMEANOR.
                                                                        
  7    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  8        SECTION  1.  That  Chapter  33,  Title 18, Idaho Code, be, and the same is
  9    hereby amended by the addition thereto of a NEW SECTION, to be known and  des-
 10    ignated as Section 18-3302H, Idaho Code, and to read as follows:
                                                                        
 11        18-3302H.  THREATENING  VIOLENCE  ON  SCHOOL GROUNDS. Any person who will-
 12    fully threatens to commit an act of violence on school grounds  by  use  of  a
 13    firearm,  explosive,  or  deadly  or  dangerous  weapon  as defined in section
 14    18-3302D, Idaho Code, is guilty of a misdemeanor.

Statement of Purpose / Fiscal Impact



                       STATEMENT OF PURPOSE
                             RS 13923

This legislation will amend Chapter 33, Title 18 of the Idaho
Code, relating to threats of violence. By the addition of a new
section 18-3302H, Idaho Code, to provide that any person who
willfully threatens to commit an act of violence on school
grounds by use of a firearm, explosive, or deadly or dangerous
weapon is guilty of a misdemeanor.


                          FISCAL IMPACT
There is no fiscal impact to the state or local jurisdiction.
