]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-seventh Legislature Second Regular Session - 2004IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 696 BY HEALTH AND WELFARE COMMITTEE 1 AN ACT 2 RELATING TO MEDICAID; AMENDING CHAPTER 2, TITLE 56, IDAHO CODE, BY THE ADDI- 3 TION OF A NEW SECTION 56-209m, IDAHO CODE, TO DIRECT THE DIRECTOR OF THE 4 DEPARTMENT OF HEALTH AND WELFARE TO APPLY FOR A WAIVER TO CONDUCT A PILOT 5 PROJECT FOR SERVICES RELATED TO WEIGHT CONTROL BASED UPON AVAILABLE FUND- 6 ING. 7 Be It Enacted by the Legislature of the State of Idaho: 8 SECTION 1. That Chapter 2, Title 56, Idaho Code, be, and the same is 9 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 10 ignated as Section 56-209m, Idaho Code, and to read as follows: 11 56-209m. WEIGHT CONTROL PILOT PROJECT. Based upon available funding, the 12 director of the department of health and welfare is directed to apply for the 13 appropriate waiver or waivers from the centers for medicare and medicaid ser- 14 vices for the state medicaid program to conduct a pilot project to determine 15 the effectiveness of, and projected cost savings which may result from, pro- 16 viding reimbursement for weight control therapies, including anorexic drugs, 17 and nutritional, diet and exercise counseling, in the state medicaid drug pro- 18 gram.

NO. 696 1 AMENDMENT TO SECTION 1 2 On page 1 of the printed bill, in line 18, following "gram" insert: ", 3 with the following limitations: 4 (1) Participation in the pilot program shall be limited to one hundred 5 (100) clients; 6 (2) The length of the pilot program shall be limited to three (3) years; 7 (3) Participation shall be limited to clients with a body mass index 8 (BMI) over twenty-five (25); and 9 (4) The department shall report annually to the senate and house health 10 and welfare committees concerning the progress on all programs initiated under 11 the waiver". 12 CORRECTION TO TITLE 13 On page 1, in line 6, following "ING" insert: "AND TO PROVIDE LIMITA- 14 TIONS".

STATEMENT OF PURPOSE RS 14029 C1 This bill directs the department of Health and Welfare to apply for a waiver from the Center for Medicare and Medicaid Services to conduct a pilot project to determine the effectiveness of priority reimbursement for weight control therapies. FISCAL IMPACT Preliminary estimates are: a pilot would effect 100 persons and cost $1,500 per client. State share of the cost would be $45,000.
