COSMETOLOGY BOARD - Amends existing law to delete language providing for
the appointment of cosmetologists to the Cosmetology Board by the Governor;
to provide that the board shall appoint licensed persons to serve as
examining assistants for three year terms to assist the board in the
administration of licensure examinations; and to provide for compensation
for examining assistants.

1 AN ACT
2 RELATING TO COSMETICIANS; AMENDING SECTION 54-828, IDAHO CODE, TO DELETE LAN-
3 GUAGE PROVIDING FOR THE APPOINTMENT OF COSMETOLOGISTS BY THE GOVERNOR AND
4 TO MAKE TECHNICAL CORRECTIONS; AMENDING SECTION 54-831, IDAHO CODE, TO
5 PROVIDE THAT THE BOARD SHALL APPOINT LICENSED PERSONS TO SERVE AS EXAMIN-
6 ING ASSISTANTS FOR THREE YEAR TERMS TO ASSIST THE BOARD IN THE ADMINISTRA-
7 TION OF LICENSURE EXAMINATIONS AND TO MAKE A TECHNICAL CORRECTION; AND
8 AMENDING SECTION 54-832, IDAHO CODE, TO PROVIDE FOR COMPENSATION FOR EXAM-
9 INING ASSISTANTS.
10 Be It Enacted by the Legislature of the State of Idaho:
11 SECTION 1. That Section 54-828, Idaho Code, be, and the same is hereby
12 amended to read as follows:
13 54-828. IDAHO BOARD OF COSMETOLOGY -- APPOINTMENT -- TERM. There is
14 hereby created in the department of self-governing agencies a board to be
15 known as the "Idaho Board of Cosmetology." It shall consist of three (3) reg-
16 istered cosmetologists, one (1) from the northern section of the state, one
17 (1) from the south central section of the state, and one (1) from the south-
18 eastern section of the state, one (1) electrologist/esthetician and one (1)
19 currently active cosmetology school representative, appointed by the governor
20 from among nominees recommended by any organized and generally recognized
21 group of cosmetologists in this state. The members of the board shall be
22 appointed) for terms of three (3) years. On the expiration of the term of any
23 member, his successor shall be appointed in like manner by the governor for a
24 term of three (3) years. Vacancies shall be filled in like manner for the
25 unexpired portion of the term. Members of the board shall hold office until
26 their successors have been appointed and have qualified. The board may, by
27 written agreement, authorize the bureau of occupational licenses as agent to
28 act in its interest.
29 The governor shall appoint two (2) active, licensed registered cosmetolo-
30 gists in each district who shall have authority to assist in conducting cosme-
31 tology examinations and they shall be paid such amounts as the board deter-
32 mines, when performing board duties.
33 The action and report in writing of a majority of the board with reference
34 to the violation of any of the provisions of this chapter shall be the basis
35 for the board to proceed according to the provisions of sections 54-816,
36 54-817, and 54-821, Idaho Code.
37 SECTION 2. That Section 54-831, Idaho Code, be, and the same is hereby
38 amended to read as follows:
39 54-831. BOARD -- ORGANIZATION AND MEETINGS. The board shall hold a meet-
40 ing within thirty (30) days after its members are first appointed, and there-
41 after board meetings shall be held at such times and places as may be decided

1 upon.
2 The board shall adopt such by-laws bylaws as it deems necessary and proper
3 for the conduct of its business, and shall appoint persons licensed under the
4 provisions of this chapter to serve as examining assistants for terms of three
5 (3) years who shall assist the board in the administration of licensure exami-
6 nations. The board shall annually elect a chairman, vice-chairman, and secre-
7 tary from among its members. A majority of the members of the board shall con-
8 stitute a quorum.
9 SECTION 3. That Section 54-832, Idaho Code, be, and the same is hereby
10 amended to read as follows:
11 54-832. COMPENSATION AND EXPENSES OF BOARD MEMBERS. Each member of the
12 board and each examining assistant shall be compensated as provided by section
13 59-509(n), Idaho Code.
STATEMENT OF PURPOSE
RS 14030
This legislation amends Section 54-828, Idaho Code, by striking
language that provides the Governor's appointment of two (2)
cosmetologists in each district as examination assistants and
providing for their reimbursement.
Amends Section 54-831, Idaho Code, by adding language that places
the responsibility for appointment of examining assistants with
the Board of Cosmetology, setting the terms of appointment at
three (3) years.
Amends Section 54-832, Idaho Code, adding language to include
examining assistants compensation as provided by Section 59-
509(n), Idaho Code.
FISCAL IMPACT
There will be no impact to the general fund. The impact on
dedicated funds will be the cost of training, travel and
reimbursement for the services of the examination assistants.
