10 CODE, TO PROVIDE FOR A DISCOUNT BASED UPON AN INDIVIDUAL'S WEIGHT OR
11 ADHERENCE TO A SCHEDULE FOR PHYSICALS AND TO ALLOW FOR FINANCIAL INCEN-
12 TIVES; AND AMENDING CHAPTER 39, TITLE 41, IDAHO CODE, BY THE ADDITION OF A
13 NEW SECTION 41-3941, IDAHO CODE, TO PROVIDE FOR A DISCOUNT BASED UPON AN
14 INDIVIDUAL'S WEIGHT OR ADHERENCE TO A SCHEDULE FOR PHYSICALS AND TO ALLOW
15 FOR FINANCIAL INCENTIVES.
16 Be It Enacted by the Legislature of the State of Idaho:
17 SECTION 1. That Chapter 21, Title 41, Idaho Code, be, and the same is
18 hereby amended by the addition thereto of a NEW SECTION, to be known and des-
19 ignated as Section 41-2145, Idaho Code, and to read as follows:
20 41-2145. DISCOUNT FOR HEALTHY WEIGHT. (1) Notwithstanding any other pro-
21 vision of law, all disability contracts which are delivered, issued for deliv-
22 ery, continued or renewed on or after July 1, 2004, in this state may offer an
23 additional discount of up to twenty percent (20%) of the premium rate for the
24 policy based upon an individual's weight or adherence to a recommended sched-
25 ule for regular physicals. With respect to weight and regular physicals, the
26 discount must be based upon the individual's compliance with the centers for
27 disease control and prevention guidelines in effect on the year of issuance or
28 renewal of the policy.
29 (2) If approved by the director of the department of insurance, the con-
30 tract may include provisions with financial incentives encouraging a policy-
31 holder to receive health care services at a high-quality provider designated
32 by the carrier based on objective quality indicators.
33 SECTION 2. That Chapter 22, Title 41, Idaho Code, be, and the same is
34 hereby amended by the addition thereto of a NEW SECTION, to be known and des-
35 ignated as Section 41-2224, Idaho Code, and to read as follows:
36 41-2224. DISCOUNT FOR HEALTHY WEIGHT. (1) Notwithstanding any other pro-
37 vision of law, all group or blanket disability insurance policies which are
38 delivered, issued for delivery, continued or renewed on or after July 1, 2004,
39 in this state may offer an additional discount of up to twenty percent (20%)
40 of the premium rate for the policy based upon an individual's weight or adher-
41 ence to a recommended schedule for regular physicals. With respect to weight

1 and regular physicals, the discount must be based upon the individual's com-
2 pliance with the centers for disease control and prevention guidelines in
3 effect on the year of issuance or renewal of the policy.
4 (2) If approved by the director of the department of insurance, the pol-
5 icy may include provisions with financial incentives encouraging a policy-
6 holder to receive health care services at a high-quality provider designated
7 by the carrier based on objective quality indicators.
8 SECTION 3. That Chapter 34, Title 41, Idaho Code, be, and the same is
9 hereby amended by the addition thereto of a NEW SECTION, to be known and des-
10 ignated as Section 41-3444, Idaho Code, and to read as follows:
11 41-3444. DISCOUNT FOR HEALTHY WEIGHT. (1) Notwithstanding any other pro-
12 vision of law, all group subscribers' contracts which are delivered, issued
13 for delivery, continued or renewed on or after July 1, 2004, in this state may
14 offer an additional discount of up to twenty percent (20%) of the premium rate
15 for the policy based upon an individual's weight or adherence to a recommended
16 schedule for regular physicals. With respect to weight and regular physicals,
17 the discount must be based upon the individual's compliance with the centers
18 for disease control and prevention guidelines in effect on the year of issu-
19 ance or renewal of the policy.
20 (2) If approved by the director of the department of insurance, the con-
21 tract may include provisions with financial incentives encouraging a policy-
22 holder to receive health care services at a high-quality provider designated

24 SECTION 4. That Chapter 39, Title 41, Idaho Code, be, and the same is
25 hereby amended by the addition thereto of a NEW SECTION, to be known and des-
26 ignated as Section 41-3941, Idaho Code, and to read as follows:
27 41-3941. DISCOUNT FOR HEALTHY WEIGHT. (1) Notwithstanding any other pro-
28 vision of law, all policies, contracts, plans or certificates issued by an
29 organization offering a managed care plan which are delivered, issued for
30 delivery, continued or renewed on or after July 1, 2004, in this state may
31 offer an additional discount of up to twenty percent (20%) of the premium rate
32 for the policy based upon an individual's weight or adherence to a recommended
33 schedule for regular physicals. With respect to weight and regular physicals,
34 the discount must be based upon the individual's compliance with the centers
35 for disease control and prevention guidelines in effect on the year of issu-
36 ance or renewal of the policy.
37 (2) If approved by the director of the department of insurance, the pol-
38 icy, contract, plan or certificate may include provisions with financial
39 incentives encouraging a policyholder to receive health care services at a
40 high-quality provider designated by the carrier based on objective quality
41 indicators.
STATEMENT OF PURPOSE
RS 14032
This legislation provides for an insurance rate discount of up to
20% of the premium rate for a policy based upon an individual's
weight or adherence to a recommended schedule of physicals. The
discount would be based on adherence to CDC prevention guidelines.
This bill provides a financial incentive for a person to maintain
a normal weight and to adopt a healthy lifestyle.
FISCAL NOTE
There is no fiscal impact to the general fund.
