  1                                        AN ACT
  2    RELATING  TO  THE  EMERGENCY  MEDICAL  SERVICES  FUND  III;  AMENDING  SECTION
  3        56-1018B, IDAHO CODE, TO PROVIDE ADDITIONAL CRITERIA TO  GOVERN  DISTRIBU-
  4        TIONS FROM THE FUND AND TO CORRECT SUBSECTION REFERENCES.
                                                                        
  5    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  6        SECTION  1.  That Section 56-1018B, Idaho Code, be, and the same is hereby
  7    amended to read as follows:
                                                                        
  8        56-1018B.  EMERGENCY MEDICAL SERVICES FUND III. (1) There is  hereby  cre-
  9    ated in the dedicated fund of the state treasury a fund known as the emergency
 10    medical services fund III. Subject to appropriation by the legislature, moneys
 11    in  the  fund  shall be used exclusively for the purpose of acquiring vehicles
 12    and equipment for use by emergency medical services personnel in  the  perfor-
 13    mance  of  their duties which include highway safety and emergency response to
 14    motor vehicle accidents.
 15        (2)  The bureau of emergency medical services of the department of  health
 16    and  welfare  shall  be  responsible  for distributing moneys from the fund to
 17    qualifying nonprofit and governmental entities that submit an application  for
 18    a  grant from the fund. The bureau shall approve grants based on the following
 19    criteria:
 20        (a)  Of the amount appropriated annually by the legislature, fifty percent
 21        (50%) shall be distributed to entities with an annual call volume  greater
 22        than  one thousand (1,000) and fifty percent (50%) shall be distributed to
 23        entities with an annual call volume less than one thousand (1,000);
 24        (b)  The requesting entity is a nonprofit  or  governmental  entity  which
 25        holds  a current license as an ambulance or nontransport service issued by
 26        the state of Idaho;
 27        (c)  The requesting entity has submitted quarterly patient care records to
 28        the bureau for the prior fiscal year;
 29        (bd)  The requesting entity has demonstrated need based on criteria estab-
 30        lished by the bureau;
 31        (ce)  The requesting entity has provided verification that it has received
 32        the approval and endorsement of a city or county within its service area;
 33        (df)  The requesting entity has certified that the title  to  any  vehicle
 34        purchased  with  funds  from  the fund shall be in the name of the city or
 35        county which endorsed the application and shall submit proof of titling as
 36        soon as practicable;
 37        (eg)  The state of Idaho shall retain a security interest in  the  vehicle
 38        to  secure  the  performance of the grant recipient to utilize the vehicle
 39        consistent with the intent described in the application.
 40        (3)  Notwithstanding the requirements of subsections (2)(ce)  and  (2)(df)
 41    of  this  section,  the  bureau of emergency medical services is authorized to
 42    approve and issue a grant to an applicant in the absence of an endorsement  if
 43    the endorsement is withheld without adequate justification.

Amends existing Code to provide for a division in EMS III grant
funds based on annual call volume.  Currently, agencies in urban
areas are unable to qualify for funding because of population,
service area, and budget.  This amendment would provide equal
access to funding for rural and urban emergency medical service
providers.
Additionally, this measure provides a requirement that any agency
requesting grant funds must provide quarterly patient records to
the emergency medical services bureau.
