  1                                        AN ACT
  2    RELATING TO RESIDENTIAL CARE FOR THE ELDERLY; AMENDING CHAPTER 35,  TITLE  39,
  3        IDAHO CODE, BY THE ADDITION OF A NEW SECTION 39-3523, IDAHO CODE, TO SPEC-
  4        IFY  A  MEDICATION  POLICY TO GOVERN INDIVIDUAL DOSE SYSTEMS PREPARED BY A
  5        LICENSED NURSE.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION 1.  That Chapter 35, Title 39, Idaho Code, be,  and  the  same  is
  8    hereby  amended by the addition thereto of a NEW SECTION, to be known and des-
  9    ignated as Section 39-3523, Idaho Code, and to read as follows:
                                                                        
 10        39-3523.  MEDICATIONS.  The medication policy governed by the  policy  and
 11    procedure  of the facility shall include a policy permitting, under the condi-
 12    tions specified, a licensed nurse to fill  individual  dose  systems  such  as
 13    blister pack, medi-set, or other system approved by the department. The policy
 14    shall  provide  for  appropriate  records  to maintain security of medications
 15    received from a pharmacist in accordance with pharmacy standards. The licensed
 16    nurse shall appropriately label the medication with name, dosage,  amount  and
 17    time to be taken, and special instructions if appropriate.

                       STATEMENT OF PURPOSE
                             RS 14162

Veterans, railroad retirees and some insurance companies will
only provide medication benefits if the medication is purchased
in bottles.

The purpose of this bill is to continue to allow Registered
Nurses, in assisted living facilities, to distribute medication
from bulk bottles to medisets or unit dose blister packaging. 
The bill will, thereby, aid residents in self-administration of
medication, and reduce the possibility of medication errors and
contamination.  This has been the standard procedure for nearly
10 years; however, due to conflicting rules this legislation is
necessary for consistency.

                          FISCAL IMPACT

This bill will have no adverse impact on the general fund.  If
this legislation is not passed it could cost veterans and
railroad retirees up to $900,000 a year.
