  1                                        AN ACT
  2    APPROPRIATING MONEYS TO THE ATTORNEY GENERAL FOR FISCAL  YEAR  2005;  LIMITING
  3        THE  NUMBER  OF  AUTHORIZED  FULL-TIME EQUIVALENT POSITIONS; DIRECTING THE
  4        TRANSFER OF FUNDS ON JUNE 30, 2004; REVISING THE EFFECTIVE DATES  OF  CER-
  5        TAIN  FISCAL  YEAR 2004 APPROPRIATIONS FOR THE SPECIAL LITIGATION PROGRAM;
  6        AND DECLARING AN EMERGENCY FOR SECTIONS 3 AND 4 OF THIS ACT.
                                                                        
  7    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  8        SECTION 1.  There is hereby appropriated to the Attorney General the  fol-
  9    lowing  amounts  to  be  expended for the designated programs according to the
 10    designated expense classes from the listed funds for the period July 1,  2004,
 11    through June 30, 2005:

 26        SECTION  2.  In  accordance with Section 67-3519, Idaho Code, the Attorney
 27    General is authorized no more than one hundred  seventy-eight  and  sixty-five
 28    hundredths  (178.65)  full-time  equivalent  positions at any point during the
 29    period July 1, 2004, through June 30, 2005, for the programs specified in Sec-
 30    tion 1 of this act, unless specifically authorized by the Governor. The  Joint
 31    Finance-Appropriations  Committee  will  be notified promptly of any increased
 32    positions so authorized.
                                                                        
 33        SECTION 3.  On or before June 30,  2004,  the  State  Controller,  at  the
 34    request  of the Attorney General, shall transfer $56,000 from the Self-Govern-
 35    ing Operating Fund in the Department of  Finance  to  the  General  Fund.  The
 36    intent  of  this  transfer  is  to mitigate the impact of adding staff for the
 37    Office of the Attorney General to provide additional  legal  services  to  the
 38    Idaho Department of Finance in fiscal year 2005.
                                                                        
 39        SECTION  4.  The  appropriation  made  in  Section 2, Chapter 191, Laws of
 40    2003, and the appropriation made in Section 10, Chapter 348, Laws of 2003, for

  1    the Special Litigation Program within the Office of the Attorney General shall
  2    be for the period July 1, 2003, through June 30, 2005.
                                                                        
  3        SECTION 5.  An emergency existing  therefor,  which  emergency  is  hereby
  4    declared  to  exist,  Sections  3 and 4 of this act shall be in full force and
  5    effect on and after passage and approval.

SECTION 2. of this bill provides for an FTP Cap of 178.65.

SECTION 3. of this bill transfers $56,000 from the Idaho Department of Finance by June 30, 2004 to mitigate the costs of additional legal services in FY 2005.

SECTION 4. provides reappropriation authority for the Special Litigation Program in the General Fund from FY 2004 into FY 2005.

SECTION 5. provides for an emergency clause for SECTIONS 3 and 4.
