  2    RELATING TO COURSES OF INSTRUCTION; AMENDING CHAPTER 16, TITLE 33, IDAHO CODE,
  3        BY THE ADDITION OF A NEW SECTION 33-1617, IDAHO CODE, TO REQUIRE  DEVELOP-
  4        MENT  OF  GOALS  FOR  ENGLISH  LANGUAGE  LEARNERS, FORMULATION OF DISTRICT
  5        PLANS, REPORTS TO THE STATE BOARD OF EDUCATION AND RECOMMENDATIONS TO  THE
  6        LEGISLATURE.
                                                                        
  7    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  8        SECTION  1.  That  Chapter  16,  Title 33, Idaho Code, be, and the same is
  9    hereby amended by the addition thereto of a NEW SECTION, to be known and  des-
 10    ignated as Section 33-1617, Idaho Code, and to read as follows:
                                                                        
 11        33-1617.  ENGLISH  LANGUAGE LEARNERS -- PROGRAM REQUIREMENTS. It is legis-
 12    lative intent that the state board of education and state department of educa-
 13    tion develop statewide, research-based goals for students  in  Idaho  who  are
 14    English  language  learners.  Goals shall specifically address compliance with
 15    applicable state and federal law and court decisions.
 16        The board of trustees of each school district shall formulate  a  plan  in
 17    sufficient  detail  that measurable objectives can be identified and addressed
 18    which will accomplish English language acquisition and improved academic  per-
 19    formance.  Moneys distributed to school districts based upon the population of
 20    limited-English proficiency students and distributed to  school  districts  to
 21    support  programs for students with non-English or limited-English proficiency
 22    shall be utilized in support of the district plan.
 23        The district plan and allocation of funds shall be part of a  report  made
 24    annually  to  the  state board of education and state department of education.
 25    The state board of education shall provide a summary of these reports  to  the
 26    legislature.   Recommendations  for  program  enhancements needed to reach the
 27    statewide goals are to be brought to the legislature after review and approval
 28    by the state board of education.

Statement of Purpose / Fiscal Impact



                       STATEMENT OF PURPOSE
                             RS 14195

The purpose of this legislation is to require the State Board of
Education and the State Department of Education to develop
statewide, research-based goals for students in Idaho who are
English language learners using Limited-English Proficient (LEP)
monies which are allocated on a per capita basis. School district
boards of trustees will develop a detailed plan with measurable
objectives. An annual report with recommendations to the
legislature will be made by the State Board of Education.


                          FISCAL IMPACT

There is no increase in funding. A plan and accountability
measures are created for an existing allocation of resources.
