  2    APPROPRIATING MONEYS FOR THE OFFICE OF THE STATE BOARD OF EDUCATION FOR FISCAL
  3        YEAR 2005; LIMITING THE NUMBER OF FULL-TIME EQUIVALENT POSITIONS; EXPRESS-
  4        ING LEGISLATIVE INTENT REGARDING RESOURCE SHARING; DIRECTING REIMBURSEMENT
  5        OF DONATED FUNDS TO THE IDAHO HOSPITAL ASSOCIATION; REDUCING THE APPROPRI-
  6        ATION FOR THE OFFICE OF THE STATE BOARD OF EDUCATION FOR FISCAL YEAR 2004;
  7        AND DECLARING AN EMERGENCY FOR SECTION 5 OF THIS ACT.
                                                                        
  8    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  9        SECTION 1.  There is hereby appropriated to the State Board  of  Education
 10    for  the  Office  of  the State Board of Education the following amounts to be
 11    expended according to the designated expense classes from the listed funds for
 12    the period July 1, 2004, through June 30, 2005:

 28        SECTION 2.  In accordance with Section 67-3519, Idaho Code, the agency  is
 29    authorized  no more than twenty-two (22) full-time equivalent positions at any
 30    point during the period July 1, 2004, through June 30, 2005, for  the  program
 31    specified in Section 1 of this act, unless specifically authorized by the Gov-
 32    ernor. The Joint Finance-Appropriations Committee will be notified promptly of
 33    any increased positions so authorized.
                                                                        
 34        SECTION  3.  The  Legislature reaffirms that the Division of Professional-
 35    Technical Education, the Division of Vocational Rehabilitation and the  Office
 36    of  the  State  Board  of  Education  each  play unique and vital roles in the
 37    state's educational system. The Legislature authorizes these agencies to share
 38    administrative resources only to  the  extent  necessary  to  achieve  readily
 39    obtainable  administrative  efficiencies.  The  shared resources authorized in
 40    this section shall be narrowly defined as human resources,  information  tech-
 41    nology, reception and the fiscal activities of accounts payable, payroll proc-
 42    essing  and financial statement and budget preparation. Each division adminis-

  1    trator shall retain management decision-making autonomy over their  respective
  2    divisions.  The  employees of the Division of Professional-Technical Education
  3    and the Division of Vocational Rehabilitation shall not be considered or  used
  4    as  adjunct staff by the Office of the State Board of Education. Under no cir-
  5    cumstances shall this arrangement impair the individual ability of these agen-
  6    cies to fulfill their individual missions. This authorization is automatically
  7    withdrawn to the extent it is found to be inconsistent with  laws  or  regula-
  8    tions  pertaining  to  the  use of federal or dedicated funds. The Legislature
  9    shall review this authorization each year and reserve its prerogative to with-
 10    draw it at any time.
                                                                        
 11        SECTION 4.  The 2002 Idaho Legislature adopted House Concurrent Resolution
 12    No. 58 to recognize the state and national nursing  shortage  and  to  request
 13    that  the  State  Board  of Education address that shortage. Subsequently, the
 14    Idaho Hospital Association donated $482,277 in fiscal year 2003  and  $439,184
 15    in  fiscal  year  2004  to  the  State  Board of Education to potentially fund
 16    initiatives developed by the State Board of Education's  Committee  on  Health
 17    Professions.  None  of those donated funds have been expended. The Legislature
 18    directs that all funds donated by the Idaho Hospital Association to the  State
 19    Board  of  Education  for  the  purposes  of supporting the Health Professions
 20    Workforce Development Initiative be reimbursed to the Idaho Hospital  Associa-
 21    tion.  The reimbursed amount shall reflect reasonable interest earned on those
 22    funds and reasonable administrative fees charged against those funds as agreed
 23    to by the Idaho Hospital Association and the State  Board  of  Education.  The
 24    State  Board  of Education shall provide the Joint Finance-Appropriations Com-
 25    mittee with a full and complete  accounting  of  the  transaction  immediately
 26    after it is consummated.
                                                                        
 27        SECTION  5.  The  appropriation  to  the  State Board of Education for the
 28    Office of the State Board of Education made in Section 1, Chapter 226, Laws of
 29    2003, is hereby reduced for the designated expense class from the listed  fund
 30    for the period July 1, 2003, through June 30, 2004:

 35        SECTION  6.  An  emergency  existing  therefor,  which emergency is hereby

This appropriation includes a one-time, General Fund rescission of $1,500,000 for FY 2004 in Section 5. Section 6 is an emergency clause makes the rescission effective immediately upon passed and approval of this bill.

FY 2005 begins with a General Fund Base Reduction of $1,000,000. Of that amount, $611,700 is one-time and $388,300 is ongoing. Also included is funding to cover Personnel Cost Rollups and a 2% Change in Employee Compensation. Nonstandard Adjustments reduce interagency billings by $7,600. One of the two requested and recommended enhancements is authorized in this appropriation. It provides federal fund spending authority and three full-time equivalent positions for the State Board of Education to assume State Education Agency responsibilities from the State Department of Education. Dedicated fund spending authority for the Health Professions Workforce Development enhancement is not provided. Section 4 includes intent language that directs the State Board of Education to reimburse to the Idaho Hospital Association nearly $1 million that the IHA had donated in an effort to work with the State Board of Education to get more nurses to the bedside. Section 2 limits the number of full-time equivalent positions to 22.0. Section 3 authorizes the Office of the State Board of Education, the Division of Professional-Technical Education and the Division of Vocational Rehabilitation to share administrative resources to achieve readily obtainable efficiencies provided the ability of the individual agencies to execute their individual missions is not impaired.
