]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-seventh Legislature Second Regular Session - 2004IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 816 BY WAYS AND MEANS COMMITTEE 1 AN ACT 2 RELATING TO THE INSPECTION AND SUPPRESSION OF DISEASES IN ANIMALS; AMENDING 3 CHAPTER 2, TITLE 25, IDAHO CODE, BY THE ADDITION OF A NEW SECTION 25-220, 4 IDAHO CODE, TO PROHIBIT THE IMPORTATION OF CATTLE ORIGINATING IN CANADA 5 INTO THE STATE OF IDAHO UNLESS CERTAIN IDENTIFICATION REQUIREMENTS ARE 6 MET; AND AMENDING SECTION 25-230, IDAHO CODE, TO STRIKE OBSOLETE LANGUAGE, 7 TO PROVIDE CORRECT TERMINOLOGY AND TO MAKE TECHNICAL CORRECTIONS. 8 Be It Enacted by the Legislature of the State of Idaho: 9 SECTION 1. That Chapter 2, Title 25, Idaho Code, be, and the same is 10 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 11 ignated as Section 25-220, Idaho Code, and to read as follows: 12 25-220. IMPORTATION OF CATTLE FROM CANADA -- IDENTIFICATION REQUIREMENTS. 13 It shall be unlawful for any person, firm or corporation or its agents or 14 employees to bring or cause to be brought in any manner whatsoever into this 15 state cattle that have originated in Canada unless the cattle: 16 (1) Bear the brand "C" on the neck, by hot iron or freeze iron, with 17 character dimensions as provided in section 25-1141, Idaho Code; and 18 (2) Are identified with a radio frequency identification (RFID) device 19 which conforms to U.S. animal identification plan standards or with an implant 20 in accordance with regulations of the USDA. 21 SECTION 2. That Section 25-230, Idaho Code, be, and the same is hereby 22 amended to read as follows: 23 25-230. PENALTY FOR VIOLATION.OF REGULATIONS.Any person, firm or corpo- 24 ration violating any of the provisions of thisactchapter shall be guilty of 25 a misdemeanor, and upon conviction, shall be subject to a fine of not less 26 than one hundred dollars ($100), nor more than five thousand dollars ($5,000) 27 for each offense.

NO. 816 1 AMENDMENTS TO SECTION 1 2 On page 1 of the printed bill, following line 15, insert: 3 "(1) Are consigned directly to a slaughter facility; or"; 4 in line 16, delete "(1)" and insert: "(2)"; and in line 18, delete "(2)" and 5 insert: "(3)". 6 CORRECTION TO TITLE 7 On page 1, in line 5, delete "CERTAIN IDENTIFICATION REQUIREMENTS ARE"; in 8 line 6, delete "MET" and insert: "THEY ARE CONSIGNED DIRECTLY TO A SLAUGHTER 9 FACILITY OR BEAR THE BRAND "C" ON THE NECK, AND ARE IDENTIFIED WITH A RADIO 10 FREQUENCY IDENTIFICATION DEVICE".

STATEMENT OF PURPOSE RS 14245 The purpose of this legislation is to set up an identification system by which the Agriculture Department and/or the Brand Department can identify cattle that enter the State of Idaho from Canada.
