  1                                        AN ACT
  2    RELATING TO THE HEALTHY IDAHO ADVISORY COMMITTEE; AMENDING CHAPTER  10,  TITLE
  3        56,  IDAHO  CODE, BY THE ADDITION OF A NEW SECTION 56-1054, IDAHO CODE, TO
  4        CREATE THE HEALTHY IDAHO ADVISORY COMMITTEE, TO SET FORTH  MEMBERSHIP,  TO
  5        PROVIDE  FOR  THE  ELECTION OF A CHAIR, TO PROVIDE THAT A MAJORITY CONSTI-
  6        TUTES A QUORUM, TO REQUIRE MONTHLY MEETINGS, TO PROVIDE THAT MEMBERS SERVE
  7        WITHOUT PAY, TO PROVIDE THAT THE COMMITTEE SHALL MAKE RECOMMENDATIONS  AND
  8        TO SET FORTH CONSIDERATIONS.
                                                                        
  9    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 10        SECTION  1.  That  Chapter  10,  Title 56, Idaho Code, be, and the same is
 11    hereby amended by the addition thereto of a NEW SECTION, to be known and  des-
 12    ignated as Section 56-1054, Idaho Code, and to read as follows:
                                                                        
 13        56-1054.  HEALTHY  IDAHO  ADVISORY  COMMITTEE. (1) There is hereby created
 14    within the office of the governor a "Healthy Idaho Advisory Committee,"  here-
 15    inafter  referred  to as the committee, to consist of up to fourteen (14) mem-
 16    bers. The members of the committee may represent the following:
 17        (a)  One (1) representative from each of the following to be appointed  by
 18        the governor:
 19             (i)   The department of health and welfare;
 20             (ii)  Idaho dietetic association;
 21             (iii) Idaho academy of pediatrics;
 22             (iv)  Idaho academy of family practice;
 23             (v)   Idaho association of health, physical education, recreation and
 24             dance;
 25             (vi)  One  (1)  member  to represent jointly the Idaho heart associa-
 26             tion, the American cancer society, and the American lung association;
 27             and
 28             (vii) One (1) member from "Idaho on the Move"; and
 29        (b)  One (1) representative from each of the following to be appointed  by
 30        the superintendent of public instruction:
 31             (i)   Department of education;
 32             (ii)  Idaho school food service association;
 33             (iii) School nurses of Idaho;
 34             (iv)  Idaho association of school administrators; and
 35             (v)   A  parent-teacher association (PTA) or parent-teacher organiza-
 36             tion (PTO) in Idaho; and
 37        (c)  One (1) representative of the Idaho transportation department  to  be
 38        appointed by the director of the Idaho transportation department; and
 39        (d)  One (1) member from "Action for Healthy Kids."
 40        (2)  The  committee shall elect one (1) of its members to act as chair for
 41    a term of one (1) year. A majority of the members shall  constitute  a  quorum
 42    for  the  transaction  of business. The committee shall meet at least monthly.
 43    Members  of  the  committee  shall  serve  without  pay  pursuant  to  section

  1    59-509(b), Idaho Code.
  2        (3)  The committee shall make recommendations to the governor, the  legis-
  3    lature, the state board of education and the state board of health and welfare
  4    consistent  with  the intent and purposes of this section. The committee shall
  5    develop nutrition and physical activity recommendations and shall develop rec-
  6    ommendations for the promotion of a statewide  program to address physical in-
  7    activity and obesity. The committee shall consider the following:
  8        (a)  Statewide initiatives to increase the physical activity  and  fitness
  9        of Idahoans;
 10        (b)  Promotion of walking and biking in communities;
 11        (c)  Dissemination of nutritional information to the public;
 12        (d)  Foods  sold  individually  in school cafeterias but outside the regu-
 13        lated national school lunch program;
 14        (e)  Competitive foods as defined by the United States department of agri-
 15        culture, as in existence on January 1, 2004, and offered at schools  typi-
 16        cally  through  vending machines, student stores, school fundraisers, food
 17        carts or food concessions, and schools' energy expenditure costs for  such
 18        vending machines;
 19        (f)  The  expenditure  of funds derived from competitive food and beverage
 20        contracts;
 21        (g)  Physical education and activity in schools;
 22        (h)  Systems to ensure the implementation of nutrition and physical activ-
 23        ity standards in schools; and
 24        (i)  The monitoring and evaluating of results and reporting of outcomes.

This legislation will create a Healthy Idaho Advisory
Committee within the Office of the Governor that will require
reporting to the Governor and the legislation on a broad number
of issues related to diet and exercise in Idaho and in Idaho
schools.


                          FISCAL IMPACT

There is no fiscal impact to the general fund.
