  1                                        AN ACT
  2    APPROPRIATING   ADDITIONAL   MONEYS   TO   THE   SUPERINTENDENT   OF    PUBLIC
  3        INSTRUCTION/STATE  DEPARTMENT OF EDUCATION FOR FISCAL YEAR 2005; AUTHORIZ-
  4        ING ADDITIONAL FULL-TIME EQUIVALENT POSITIONS; AND  AMENDING  CHAPTER  15,
  5        TITLE  33,  IDAHO  CODE,  BY  THE ADDITION OF A NEW SECTION 33-1513, IDAHO
  6        CODE, TO PROVIDE FEES.
                                                                        
  7    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  8        SECTION 1.  In addition to the appropriation made in Section  1  of  House
  9    Bill  No.  822,  as enacted by the Second Regular Session of the Fifty-seventh
 10    Idaho Legislature, there is hereby appropriated to the Superintendent of  Pub-
 11    lic  Instruction/State  Department  of  Education  the following amounts to be
 12    expended according to the designated expense classes from the listed fund  for
 13    the period July 1, 2004, through June 30, 2005:

 20        SECTION  2.  In  addition to the full-time equivalent positions authorized
 21    in Section 2 of House Bill No. 822, as enacted by the Second  Regular  Session
 22    of   the   Fifty-seventh  Idaho  Legislature,  the  Superintendent  of  Public
 23    Instruction/State  Department of Education is hereby authorized two (2)  full-
 24    time equivalent positions for the period July 1, 2004, through June 30, 2005.
                                                                        
 25        SECTION  3.  That  Chapter  15,  Title 33, Idaho Code, be, and the same is
 26    hereby amended by the addition thereto of a NEW SECTION, to be known and  des-
 27    ignated as Section 33-1513, Idaho Code, and to read as follows:
                                                                        
 28        33-1513.  FEE  --  REIMBURSEMENT FOR PUPIL TRANSPORTATION COSTS. The state
 29    department of education shall assess an annual fee based on past reimbursement
 30    to school districts, to be paid by all school districts claiming reimbursement
 31    for pupil transportation costs, to defray the department's actual cost of pro-
 32    viding financial reviews of school district pupil transportation records. Such
 33    fees shall be treated, and may be claimed as reimbursable pupil transportation
 34    costs, pursuant to the provisions of section 33-1006, Idaho Code.

This appropriation for the Superintendent of Public Instruction/State Department of Education is a trailer bill to SB 1331.

Fiscal Note

This appropriation authorizes an additional 2.0 FTP and $190,100 in dedicated funds to the Superintendent of Public Instruction/State Department of Education. This additional funding will enable the department to comply with the provisions of SB 1331, which direct the department to improve its financial oversight of state funding for school district pupil transportation. The dedicated fund source for this appropriation will be audit fees collected from school districts, pursuant to Section 3 of the bill. School districts will be able to include the cost of such fees as part of their pupil transportation reimbursement claim, meaning the state will ultimately pay 85% of these costs. With the average audit finding resulting in $16,000 in savings to the state, it is expected that these positions will more than pay for the state’s 85% share of their costs.
