LEGISLATIVE COMMITTEES - TESTIMONY - Stating findings of the Legislature
and proposing a new Joint Rule 22 to the Rules of the Senate and the House
of Representatives to require that witnesses be placed under oath when
testifying before a legislative committee if the witness is speaking about
matters involving bonded indebtedness of the state, a political subdivision
or an independent body corporate politic.

HOUSE CONCURRENT RESOLUTION NO. 38
BY JUDICIARY, RULES AND ADMINISTRATION COMMITTEE
1 A CONCURRENT RESOLUTION
2 PROPOSING A NEW JOINT RULE 22 TO THE JOINT RULES OF THE SENATE AND THE HOUSE
3 OF REPRESENTATIVES.
4 Be It Resolved by the Legislature of the State of Idaho:
5 WHEREAS, the members of the House of Representatives and the Senate
6 believe that a new Joint Rule 22 should be added to the Joint Rules of the
7 Senate and the House of Representatives to provide for taking and recording
8 testimony, under oath, regarding legislative business involving bonds.
9 NOW, THEREFORE, BE IT RESOLVED by the members of the Second Regular Ses-
10 sion of the Fifty-seventh Idaho Legislature, the House of Representatives and
11 the Senate concurring therein, that the Joint Rules of the Senate and the
12 House of Representatives be amended by the addition thereto of a new Joint
13 Rule to read as follows:
14 JOINT RULE 22
15 Taking and Recording Testimony Under Oath. -- Whenever conducting legisla-
16 tive business regarding issuance of bonds involving the state, a political
17 subdivision of the state or an independent body corporate politic, a committee
18 shall require that testimony be given under oath, which shall be administered
19 by the chairman or by a person authorized by law to administer oaths. The
20 chairman may require that the testimony be recorded by an official court
21 reporter or by some other competent person, under oath, which report, when
22 written, certified and approved by the person as being the direct transcript
23 of the testimony, proceedings or documents, shall be prima facie a correct
24 statement of the testimony and proceedings provided that the person's signa-
25 ture to the certificate shall be duly acknowledged by him before a notary pub-
26 lic. Any person who takes an oath pursuant to this rule shall be notified that
27 if the person under oath states as true any material matter which he knows to
28 be false is guilty of perjury and shall be punished pursuant to chapter 54,
29 title 18, Idaho Code.

This legislation provides for a joint rule that would make it
mandatory to have testimony under oath during a bond hearing.
