                             HOUSE CONCURRENT RESOLUTION NO. 46

  1                               A CONCURRENT RESOLUTION
  2    STATING FINDINGS OF THE LEGISLATURE AND REJECTING A CERTAIN RULE OF THE  DIVI-
  3        SION OF HUMAN RESOURCES AND PERSONNEL COMMISSION.
                                                                        
  4    Be It Resolved by the Legislature of the State of Idaho:
                                                                        
  5        WHEREAS,  the  Legislature  is  vested  with authority to reject executive
  6    agency rules under the provisions of Section 67-5291, Idaho Code, in the event
  7    that the Legislature finds that the rules are not consistent with  legislative
  8    intent; and
  9        WHEREAS,  it  is the finding of the Legislature that a certain rule of the
 10    Division of Human Resources and Personnel Commission relating to  nepotism  is
 11    not consistent with legislative intent and should be rejected.
 12        NOW,  THEREFORE,  BE IT RESOLVED by the members of the Second Regular Ses-
 13    sion of the Fifty-seventh Idaho Legislature, the House of Representatives  and
 14    the  Senate concurring therein, that IDAPA 15.04.01, Section 025, rules of the
 15    Division of Human Resources and Personnel  Commission  relating  to  nepotism,
 16    adopted  as  a pending rule under Docket Number 15-0401-0301, be, and the same
 17    is hereby rejected and declared null, void and of no force and effect.

                      STATEMENT OF PURPOSE

This concurrent resolution would reject a pending rule of the 
Division of Human Resources and Personnel Commission.  The effect
of this resolution, if adopted by both houses, would be to
prevent the agency rule from going into effect.

This concurrent resolution has no fiscal impact
