HOUSE CONCURRENT RESOLUTION NO. 48
BY WAYS AND MEANS COMMITTEE
1 A CONCURRENT RESOLUTION
2 STATING FINDINGS OF THE LEGISLATURE AND REJECTING CERTAIN RULES OF THE IDAHO
3 FISH AND GAME COMMISSION RELATING TO THE TAKING OF BIG GAME ANIMALS AND
4 COMMERCIAL FISHING.
5 Be It Resolved by the Legislature of the State of Idaho:
6 WHEREAS, the Legislature is vested with authority to reject executive
7 agency rules under the provisions of Section 67-5291, Idaho Code, in the event
8 that the Legislature finds that the rules are not consistent with legislative
9 intent; and
10 WHEREAS, it is the finding of the Legislature that certain rules of the
11 Idaho Fish and Game Commission relating to the taking of big game animals and
12 commercial fishing are not consistent with legislative intent and should be
13 rejected.
14 NOW, THEREFORE, BE IT RESOLVED by the members of the Second Regular Ses-
15 sion of the Fifty-seventh Idaho Legislature, the House of Representatives and
16 the Senate concurring therein, that IDAPA 13.01.08, Section 410, Subsection
17 05, paragraphs f. and g., rules of the Idaho Fish and Game Commission govern-
18 ing the taking of big game animals and other unlawful methods of take, adopted
19 as a pending rule under Docket Number 13-0108-0301, and IDAPA 13.01.12, rules
20 of the Idaho Fish and Game Commission governing commercial fishing in the
21 state of Idaho, the entire rulemaking docket, adopted as a pending rule under
22 Docket Number 13-0112-0301, be, and the same are hereby rejected and declared
23 null, void and of no force and effect.
STATEMENT OF PURPOSE
RS 14074
This concurrent resolution would reject certain pending rules of
the Idaho Fish and Game Commission relating to the taking of big
game animals and commercial fishing. The effect of this
resolution, if adopted by both houses, would be to prevent the
agency rule from going into effect.

This concurrent resolution has no fiscal impact
