]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-seventh Legislature Second Regular Session - 2004IN THE HOUSE OF REPRESENTATIVES HOUSE CONCURRENT RESOLUTION NO. 55 BY WAYS AND MEANS COMMITTEE 1 A CONCURRENT RESOLUTION 2 STATING FINDINGS OF THE LEGISLATURE AND REJECTING CERTAIN RULES OF THE DEPART- 3 MENT OF HEALTH AND WELFARE RELATING TO LICENSED RESIDENTIAL AND ASSISTED 4 LIVING FACILITIES. 5 Be It Resolved by the Legislature of the State of Idaho: 6 WHEREAS, the Legislature is vested with authority to reject executive 7 agency rules under the provisions of Section 67-5291, Idaho Code, in the event 8 that the Legislature finds that the rules are not consistent with legislative 9 intent; and 10 WHEREAS, it is the finding of the Legislature that certain rules of the 11 Department of Health and Welfare relating to licensed residential and assisted 12 living facilities are not consistent with legislative intent and should be 13 rejected. 14 NOW, THEREFORE, BE IT RESOLVED by the members of the Second Regular Ses- 15 sion of the Fifty-seventh Idaho Legislature, the House of Representatives and 16 the Senate concurring therein, that IDAPA 16.03.22, rules of the Department of 17 Health and Welfare governing licensed residential and assisted living facili- 18 ties, section 428, subsection 01, concerning Medication Policy, and subsection 19 02, concerning Medication Distribution System, adopted as pending rules under 20 Docket Number 16-0322-0301, be, and the same are hereby rejected and declared 21 null, void and of no force and effect.
STATEMENT OF PURPOSE RS 14222 This concurrent resolution would reject certain pending administrative rules changes of the Department of Health and Welfare relating to licensed residential and assisted living facilities. The effect of this resolution, if adopted by both houses, would be to prevent the agency rules from going into effect.
